    Hi, please can you help. I sent all the creditors a CCA request. They have basically said they cant find the agreement and it isn't enforceable. Link are calling me all the time and sending letters. I complained to them and told them as they cant produce the statement of account or CCA I will not be paying anything further and to stop harassing me. One letter stated the complaint wont be upheld as they are not in breach and the fact that I was paying and now stopped means that it is liable and I have to pay. I have also got a letter back from Idem who said they will pay me a visit to my home even though they cant produce my requests. Please can you help. Thank you

    Write back to them to explain that they have been warned that you consider their behaviour as harassment contrary to the Protection from Harassment Act 1997 s.1 and that if they continue their actions you will issue legal proceedings against them without further reference to them. Advise them that Ferguson v British Gas 2009 established that an entity can harass an individual.

      While youre at it, remind them of their finest day in Court in this case, https://www.bailii.org/ew/cases/EWHC...e/2011/B3.html telephone harrasment comes under s140A too and creates an unfair relationship which can lead to the debt being written off per the above link
