  • Wording a subject access request

    I have prepared the SAR to send to Landmark NRAM on behalf of my wife and I and I have changed the wording substituting "I/me/myself" with "we/our/us" because the mortgage and it's products are in both names. Is this correct and if not should I change it back to the former?

    Also do I include my wife in the address header or just myself?

    hmmm do you know, I'm not sure, common sense would say one request as it's a joint account and to do two would mean they would have to redact all documents of your wifes information when responding to your SAR and vice versa for hers....which seems unrealistic.

    I think I'd send the one with we/our/us and one £10 - both of you sign it, and yes put your wife's name in the header and from fields - and maybe add a sentence in saying that if they do require individual requests for each of you to let you know within 7 days ?

        I can understand it makes sense to do that however the DPA is referenced throughout to the 'individual'. There's nothing in there that i'm aware of which allows a joint SAR request and given that the DPA is all about an individual's personal data, I would think that a joint request is likely to be refused. This is even more the case if a SAR request requires a prescribed fee of £10 - that £10 would only cover one individual's SAR request so you would still need to provide a further £10 for the second SAR which, in effect, would ultimately defeat the object of a joint SAR in the first place.

        That would be my view if the bank was to stick to the law, but in practice, as its a joint account they might just comply with your request and only take a single £10 prescribed fee so that there's no duplicate work involved at a later stage and redacting any information relating to your wife as Amethyst said. To avoid any doubt or risks I would agree with Amethyst in that both of you should sign and date the letter and see what they come back with. You might want to enclose a copy of both your driving licence as evidence of who you are in case they need further information to verify both of you but that's optional at this stage. Just remember they might ask further info about you if they cannot satisfy themselves that you are who you are for whatever reason.

            Hi.

            I have had all of the data on us held by Landmark Mortgages, (Nee Northern Rock), returned to me a few weeks ago and just got around to sorting through it. There's a mountain of it, (about two reams of paper), does anyone have any tips on ow to organise it for easy reference while working on it?

            There is a little sorting already by them but I think different people have done seperate portions and bundled it all together.
