      Many thanks for unravelling that particular point - I was aware that certain other sites were overly optimistic about the value of the CCA and that it would wipe out the debt! I now know that is not true., but thanks for the clarification.
      But it does seem that some DCAs leave you alone if you send the CCA letter implying that they will not seek repayment although the debt remains for a further 6 years before becoming Statute Barred. I'm not going down that route. I'm just hoping to get some low Full & Final Settlement offers once they realise I know what I'm talking about (for a change).
      I often wonder if the DCAs read our CCAs and think, "Oh no. Not another Legal Beagles person" ('person' might be a stronger word than 'person')

      Once a CCA request is sent the creditor is expected to provide a copy of the agreement or a suitable recon within 14 working days (12 days and 2 days for post)
      If they do not comply they can not enforce in a court although if they tried to claim you must defend

      Some DCAs never reply and carry on giving you grief

      Some DCAs send rubbish and carry on trying it on

      Some DCAs send what they should do and that can be tricky

      Some DCAs write and tell you that they can not find it and will not bother you unless they do find it , thats good however sometimes they find it (bad) and sometimes they sell the account on and you get chased again which is why its a good idea to keep letters because then you can copy it and send it to the new creditor

          I think it's fine if you want to run your own DMP - absolutely nothing wrong with that.

          But your comparison of Compass with Stepchange is badly mistaken.

          Let's be blunt, Compass. may have sounded very sympathetic and friendly, but they have ripped you off for years. It is unsurprising that a rogue firm such as this didn't talk to you about the level of your expenses. They just wanted to say anything that would have you sign up with them and then keep paying them their monthly fees.

          They may also have ripped the creditors off. Who knows if the creditors were given an accurate picture of your finances? You can't assume they were, so they may not have accepted your actual expenditure levels.

          Self employed DMPs are more difficult than other ones, that is the nature of the beast. But if you have been talking to Stepchange you should have been passed through to their self employment team that specialise in this. Of course you will be able to put money aside for tax bills. And your business costs (website hosting, accountants fees etc) needs to be separated from your household costs to give a true picture of your situation and what you can afford to pay towards your debts each month.

                    Interestingly, I had a call from Abbey Solicitors yesterday but I was out walking in the wind and rain and it wasn't possible to have a lengthy conversation. It will be resumed next week. I believe the way they work is to take the Compass Fee (£300), send out CCAs and make no payments to the debt; if that is true, I am not interested; can't afford to make matters worse with the Credit Reference Agencies. As it is estimated to take 12 months, they gain a £3600 fee and there are no guarantees you wil lbe debt free at the end of it.
                    One of the Compass managers who recommended this route in late February told me that 22 people on their books had successfully become debt free through Abbey (That's a question I will be asking Abbey). I am seriously doubting any organisation can wipe out huge debts in this way.
                    Has Legal Beagles hadanyone experience using a 'solicitor' to remove debts as Abbey are proposing?

                        Seems like these DMPs are going down like flies. So many people will be losing their 'fund pot'. It must be devastating for them.
                        I'm intending going to the Administrator's meeting for Comapass DMP later this month. It should be enlightening but frustrating for all those who have lost thousands.

                          Worrying. Very worrying. Sending out CCA's is fine - but if you send out a CCA and they don't send the agreement, all that happens is the debt carries on growing and being chased until eventually they take court action ( usually just before the 6 years point ) They still report to the CRA's. And they can find the agreements in between sending the CCA request and the day of the court hearing ( okay they quite often don't (have a read in our court claim forum) but do you want to risk £80k of CCJ's ? )

                          I would really like to see the Abbey docs asap please. Sounds like you'd pay them £300 a month with NOTHING going to your creditors, in the vague hope the creditor doesn't have the agreement and buggers off for over 6 years ? so you could be paying £300 a month for over 6 years ? By which time the company has gone under and run off with yet more of your money.

                          you can do that yourself for £1 a creditor - sorry £1.60 if you include stamp paper and envelope.

                          Also when is the creditors meeting and where are the details on this?

                          How long ago did you stop paying debts fully ? ( ie could defaults have dropped off your credit file already )

                          ( oh goodness I'm having such a Deja Vu moment with this debt write off / pay us what you would have paid them stuff ARRGHHHHHHHHHHHHHHH )

                                I know, it's a bit odd - I half expected them to have no idea what I was talking about when I rang them but they did... so it is definately them. The reception lady did sound a bit unsure though.

                                I just found wingco's post from beginning of Feb ( was looking to see if anyone had more detail of what they were offering)

                                I have a DMP and have been approached by Abbey Solicitors who will take over the plan for the same monthly payment with a view to gaining write offs for mis-sold loans/credit cards or where the debt has been passed to debt collection agencies:
                                1. Has anyone had any experience of solicitors gaining write offs of mis-sold debts or debt collection agencies (DCA) lack of entitlement to the the debt?
                                2. I understand a DCA pays less than 10p in the pound for debts and therefore are likely to accept greatly reduced 'full and final' payment offers. Anyone tried this successfully?
                                So sounds more mis-sold and full&finals ? Maybe CCA then offer. Still not worth all your disposable income each month.

                                ~Ahh thinking on it maybe that's where the mortgage age discrimination bit of this thread has come from ?
