Hi could you help me..i am trying to find out if moneysolve are legally able to help with an IVA as i cant find them in the ministry of justice site they have no license number ...beginning to wonder if they are an agent of some kind already paid them £1200 for me and my OH any advise ??

I have just fed in Moneysolve into the the search at MOJ http://www.claimsregulation.gov.uk/search.aspx and I could not find them as being authorised.

My suggestion is to call the MOJ tomorrow and confirm that as if they need authorisation they could be trading ilegally.

MoneySolve are part of a liquidators (Beesley & co) Mark Beesley is the insolvency practioner does that side (google his name he come up in the gazettes a lot) and his wife - Elizabeth seems to run the debt help side and has the consumer credit licence
Licence Number:0600458.

They arent claims managers so don't need authorisation by MOJ.

Some of the claims made about IVAs were considered by the OFT to be in breach of its guidance for consumer credit licence holders engaged in the provision of debt management services, including IVAs. The businesses have been warned to take immediate action to remove or amend a number of potentially misleading statements in order to comply with the OFT's guidance, examples of such statements including:

• falsely claiming that 'up to 90 per cent of your debt may be written off' when the maximum would be in the region of 60 – 70 per cent
• falsely implying they can guarantee a favourable outcome by the use of such phrases as 'stop all interest and charges'
• failing to state that set-up and administrative fees will be required and will be taken out of payments before the creditors receive any payment
• failing to display the required warnings with the same prominence as the savings promised
• failing to state that homeowners may be required to re-mortgage their properties after 3 years
• failing to state that entering into an IVA also affects an individual's credit rating for six years.

This is the cherry for the referers

Referral Fee’s

• Debt management…. 50% of first payment & 50% of second payment.
• IVA’s £600 per completed case

Should imagine £600 is a fair old incentive to push their clients for IVA
and if the referrer gets that wonder how much the firm will take?

Part of an IVA proposal shows what money will be taken and where it will go. It is a legal requirement the Insolvency Practitioner lists exactly what money is going where. Bottom line is though, does it really matter? If you owe £30k and are paying £200 a month over 60 months to clear it, do you really care where the £12k you are spending goes as long as your debt is clear?

As a guide if it helps you, a lower level IVA such as the example i provided normally sees fees for the insolvency practise of about £2500 to £3500.

Stunning stuff this, just about sums up some of these profit making companies and I bet will go down an absolute bomb with others in the fee charging and IVA industry.

Keep these comments coming pete - we dont need to make a case when stuff like this is posted.

By the way I saw someone earlier this week with a failed IVA (bag full of paperwork brought in) - I think she has paid somewhere in the region of £7000 into it and guess what, she is back at square one (minus the £7000 of course) she will likely now be going bankrupt which looks to have been the best option at the outset in this particular case.

Not the IVA company helping her now though, I wonder why

Unbelievabale. Mr Holden, what can I say? There are so many excellent FREE sources of debt advice, many of whom can sort out IVA's.

Can I ask, if you dare to show your face again, does that mean your company gets between £2.5-3.5K for each IVA? If so, how many do you do in an average week? I might take a look at your company accounts, they may be revealing.
