          Good.

Whens the return date for the defence? (count 28 days from deemed served date)

Well that isn't allowed at all.

              Hi Ame,

Assuming the served date is that from the court - 03 Jul - the return date will be 31 Jul.

              Thanks.

                Hi,

I assume we won't be hearing anything from either Bryan or Nationwide before the 31st. What do I need to send to the court as a defence in this case?

                Thanks.

                      Re: Bryan Carter CCJ

                      Hi everyone,

All that's come back is a letter from Nationwide telling us that we sent the SAR to the wrong company! Strange since it was sent to the address on the ccj from the court. They want the cheque payable to Nationwide Corporate Account, quite hiow we were supossed to know this escapes me!! They also say they have 40 days from receipt of the request, and payment, to send the info. As expected nothing from BC!

                      Thanks.

Sorry for butting in this thread, Mr Carter had a CCJ against me a while back, the bailiffs collected so much and outstanding was £61.00..he did his party trick of a part claim..
He then followed up with three letters demanding the outstanding but of the full amount of the original debt using the warrant number of the part claim..
                        Naughty naughty Mr Carter

                              Hi,

Not doing good on the date front, assume that the defence needs to be in by 31st July, 28 days from the issue date of the N1? Do we add a couple of days for delivery?

We haven't had any response to the SARs from either Mr C or Nationwide as yet, can we apply to the court for a delay until such time as we have the full details of the claim before registering the defence?

I've read through Jets pages, I'm not sure about how to proceed as this is a CCA claim, also it's not been split into more than one claim. Should we follow the N1 Served thread from Wendy B? CB also mentioned that Mr C couldn't claim the extra interest, is this worth persuing?

My daughter has now be signed on the sick for a month, not sure when or if she'll be able to return - it's physical but can be accentuated by stress! Her pay has gone down to SSP.

                              Thanks

Yep, I'd follow the same idea we used with Wendy.
Have a look at this for guidance.
