    From previous experience he tends to fold on receipt of the pt18.
    So I would advise;
    • send pt18 (recorded or best next day guaranteed)
    • acknowledge service a few days before deadline
    • file defence, again just before deadline, based on his abuse of s35 and failure to comply with pt18 request hence frustrating proceedings. With draft order to strike out.

                CPR Part 18 requests are specifically excluded (under CPR Part 27) from Small Claims proceedings. You could send it by all means, but that does not mean Brian Carter would have to comply and neither would the court be likely to order him to.

                  True enough but there is nothing stopping you asking for all the supporting information to enter a FULL defence his non-compliance can still be brought to the courts attention as to frustrate proceedings.

                        You are using the part 18 to get information (or actually your not using it to GET information, more as a way to shut him up and make him back off) if you do a SAR too you are demonstrating to the court that you do ACTUALLY need the information in order to proceed with a Full defence and arent using the Part 18 as a tactical manoevure..one which isnt actually enforceable by the court in this instance.....even tho it is. If you know what i mean.

                          Right, have decided that I am not going to tell OH, end of story. After discussions with Ame, this is what I propose. letter to brian, something along the lines as follows

                          Dear ratbag

                          with regard to your claim xxxxxx in the sum of........

                          I am prepred to pay the sum of £195 which you say is due under a previous agreement, numbered xxxxxxx. Please forward a copy of the aforementioned agreement, which i have no recollection of either seeing, or signing. Please also forward a breakdown of how the £195 arrears is made up.

                          With regard to the above mentioned court claim, number xxxx, may I remind you that it is an offence under section blah blah of county court act thingy to split the claim wotsit (all that stuff mentioned previousl but I'm in a rush and will put that bit in later). should you persist in this claim I will use the aforementioned in my defence, which will no doubt result in your claim being struck out.

                          However, in an attempt to bring this to a satisfactory conclusion for both parties, i am prepared to pay the aforementioned £195 in full and final settlement of the debt.


                          I know thats a bit mixed up and back to front, but I'm in a rush. What do you think of the general gist of it though?

                                Becareful making offers of payment, especially on an agreement you have no knowledge of.
                                You don't want to admit ANYTHING.

                                A simple reword will do it
