    Re: Help

Do you have the fight to sue them for their exorbitant charges and fees ?

At least that way paying off the SD will get them off your back, but then YOU can go on the offensive.
Basically there is no way in hell this debt should of ever increased the way it has especially as there is NOT a specific contractual term that covers this. GoDebt are simply making this up and fleecing you for as much as they can.
SD can work in two ways, they aren't simply for companies to use against individuals, but they can be used the other way.
I wonder if they would like a taste of their own medicine ???

There are alot of people here that will willing assist with this undertaking and take some perverse pleasure in doing so.

At the end of the day the choice is yours, but please think about it.
Fighting the feckers is extremely rewarding in more ways than one !!!

    Re: Help

hello everyone, my husband today has sourced a loan to pay of the *******s Go debt/Hollis briggs.
Due to the fact the stat.demand was not overturned we have no faith in the court.
Im so upset, I know this is a cop out, but my husband is not prepared to take the risk. At the end of the day because Go Debt own a solicitors they can basically put on whatever charges they want. When Go debt first contacted us it was 3.2k & now if we settle its 5.6k. They have already told us if its goes to bankrupty they want 9k plus costs because they will be charging us 2% per day the debt has been outstanding since 2003.
This is too risky & my husband wont take the gamble.
Thankyou for all your hard work looking through the paperwork for us it is appreciated, but my husband wont take the risk of either bankrupty & also the fcat Go debt can charge what they bloody well want.
After this I intend to write to the relevant bodies & show them exactly what Go Debt have bullied us into doing. Maybe a worthless cause, but it might just give a little bit of satisfaction.
I wish I had your confidence & fight, but Go Debt/Hollis Briggs have won. They prob bought the so called debt for a few hundred quid and have made thousands out of us.

Ame, that figure is the arrears and not the remaining balance.
Either way GoDebt are seriously taking the **** here.

I'm just wading my way through it now.

December 03 - claim calculation doesnt add up.

    Arrears due 885

plus compensation for lost income 2450

    LESS sale of printer 2389

    LESS discount 60.00

DOESNT EQUAL £3275 as stated on that paperwork

    am i missing something ?

How has a debt of £822.50 reached almost £9000?

Have you filed the N244 with the court and sent off a Subject Access Request to GE and to GoDebt?

okay in letter from GE dated 14/2/08 states ' the proceeds we received were deducted from the debt outstanding at that time'
    )
Do you know what that amount was at that time (January 2004)

I'd guess not thus we need the SAR on GE to find this out.

    still reading.

    Ahhh

GoDebt have confirmed the amount outstanding at the time the printer was collected was £822.50.

We havent seen the arguments you put forward for the stat demand set aside application that failed nor the original contract. You really need to type up or scan these in.

On the information you have given us so far we really cannot see why the stat demand set aside would have failed and in order to go ahead with the stay of proceedings for bankruptcy we need to know what the arguments were and why they werent accepted by the court.

If you pay, and it is your decision though we highly recommend against it, then it will not put the kybosh on bankruptcy proceedings. You will have to negotiate with godebt and they will push and push for as much as they can get out of you. It will not stop at paying the 3k.

Of course it is entirely up to you what you do, but I would suggest that if they get sniff of money that they are not entitled to collect they will be all over you like a rash and probably still make you bankrupt just because they can.

I know what you are saying, but if there is even a 1% chance that my husband will go bankrupt then we are really in the crap. Its just I feel I have found this a little too late. I think if we have found this at the stat.demand stage then I think then maybe we both wouldnt feel so worried.
There are no guarantees and even if we get a stay and the paperwork comes through and its not in our favour lets just say, then all that will happen is Go Debt/Hollis briggs will just keep putting their charges up.

If you pay it they will think they are quids in (which they will be) and go for much more.

Don't let them bully you into paying what you do not owe. If I come round to your house and bully you will you give me £3k to go away?
