They have basically given us til September to pay the 2.6k that is left. Im going to ring the court tomorrow to find out if they have told them the bankrupty is off. I dont trust them either. In the letter they have just stated that it is 3k then a further payment of 2.6k in september in full & final settlement.
Once I get confirmation from the court Im sending off the letter with regards the SAR, that will **** Go debt off just a little I hope.
My calculations were the same as the above. I told them I was willing to pay the £885. They said the printer being taken & being sold doesnt make any difference because the printer was always the property of GE Capital (Paul Evans said that on Thursday). You cant argue with these people. You think you have a legitimate argument & they just **** all over it & then just keep threatening more charges. If we didnt agree to the 5.6k they were going to make it 9k. We just couldnt take the chance.

so do I, its a scary situation to be in I think, and i can understand why they've paid the 3k. thats why I asked what the F and fi figure is, cos why pay any more if the 3k is f and f.

I don't think the judge in the set aside of the stat demand looked at a single shred of evidence because its all against go debt. The debt is £886 plus interest over the 4 years and godebts charges at a push. Certainly not 3k, 5.6k or 9k.
But yes whats done is done and I do understand what rico has done in paying - hopefully going back to sue their arses will recover some of this money.

I'm with you on that one Ame, but what's done is done now, although if it was me I would be taking the above calc up with them and asking for a refund, certainly not paying another 2.6K.,

plus compensation for lost income 2450
LESS sale of printer 2389
LESS discount 3% PA of lost income 60.00
DOESNT EQUAL £3275 as stated on that paperwork

I'm confused. What amount is in full and final settlement. The 5.6k or the 3k? If you still "owe" them £2600 they can apply for bankruptcy again unless they have specifically stated that they will not. Have they done this?
The threshold is just £750.
I would not trust them an inch and had you done as was suggested, you need not have paid them £3000 either.
Is the £2600 that you have agreed to pay in September attracting interest and if so, at what rate?

That gives you 40 days to have a good read around the site and ask any questions you might have about claiming back whats rightfully yours.

I would also ask for all recordings and/or transcripts of all phone converstions that you have had with them, and all notes taken with reference to these calls.
As this is where most of their threats were made, they will probably deny having any records of these.
If they state on anything 'thats calls are recorded' etc. ie on letters, phone mesages etc.
It would be strange if they had NO info on any of the calls

Excellent, that's great news.
Right then, first of all you need information.
You need to SAR (Subject Access Request under Data Protection Act) GoDebt, GE and anyone else you can think of.
As previously said, there is no way in hell this debt should of reached this level.
You want ALL information that they hold on you, not just statements and agreements, but all correspondance and everything.
Something along these lines should do the trick: Legal Beagles , but change it to ask for ALL information they hold.
This should include, but not limited to,
• copies of original agreements
• statement of transactions
• information concerning any manual intervention
• any other supporting notes and documentation.
This has a maximum fee of £10 per subject/person.
They have a time limit of 40 days to respond to this request, else legal action can be taken.

With regards a previous posting I would dearly love to go on the offensive now & try to hurt Go debt in someway.
Im now ready to fight this 100% because we now dont have the threat of the bankrupty hanging over us.
Go debt dont have the right to do this to people and get away with it. In my case they preyed on a weak person & ended up getting their result.

I like the idea of going on the offensive because at least this way we arent gambling with the chance of being made bankrupt or more & more of their charges being added.
Im sorry I missed out the Eversheds letter. Basically it is a letter dated April 2004 saying that we owe them 3.2 k approx. The thing is we dont remember recieving this letter or speaking to them until all this crap with Go debt came to light. But the letter was a one off it seems, and there is no other paperwork from Eversheds after that.
At this moment Ive accepted we owe the 3.2k, but its the 2.4k they want in September that is getting to me. I cant believe the amount I am going to pay for a printer, that I havent got & also the fact the Go Debt said thats means nothing. I would have thought if I am about to pay all these thousands of pounds then at least I should have the bloody printer.lol
I have got myself so wound up about this. Ive gone from anger to being in tears. Go debt have bullied us to get the result they want, and they have with interest. But once its paid, I am willing to fight with your help.
