So just to reiterate and confirm Im doing it right I need to....

      1. Acknowledge claim online and defend the whole claim?

      2. Send CCA request to the claimant

      3. CPR 31.14 request to BW for copy of the agreement, copy of notice of assignment and also invoices allegedly raised?

      Thanks

I don't know how much difference it makes, but had you signed and returned the NOA (letter 4)?

I can't see the agreement in your attachments ( I'm probably being thick/blind etc but can only see assignment letters and notice that BW are going to act for PRAC )

Yep that opens fine. It does look complete and to have all the right bits in it. Do the figures on there add up right ?

I'm just going to go back through your thread see what you need to be doing now they appear to have complied with the CCA request.

                                Re: Attempting a CCJ

                                Okay
I then agreed to pay the amount of £750 in F&F which was the amount they wanted last year minus my payments already made during the year.
So options wise, as you don't have a specific defence, only the complaint procedure issue, is to go back to them with that offer ( probably slightly more) over however many months and ask it to be set up under a Tomlin Order - this would mean the claim remains on hold in court while you make the payments - if you default they can then get judgment ( so a form of security for you).

I can't see you had another defence with the original debt or anything, simply change in circs meant you couldn't keep up payments and you've been paying 'token' amounts for a period which means it won't go statute barred. However it is nearly off of your credit file, so a CCJ would be a right pain in the bum for another 6 years.

That is JUST my thoughts though okay xxxx
