    ok dont laugh when you read this

    advice needed on how to deal with this.

    The channel was activated by a drunken phone call, i thought i'd taken it for a month but it would appear it was for a year.

    I have not had any contact from the alleged debtor other that this and a previous dca letter last week.

        Love the letter with my all time favourite phrase
        This letter fufils the requirements even if not read by you

        I would send the 'I do not acknowledge any debt to you or your client' and see what they come up with

            Cough.....erm....not that I know but aren't channels such as those in 3 figures monthly advertised, and dare I say stress 'the nightly fee'.

            Couldn't you hit them with false advertising and misrepresentation as you believed you could have the channel for a single night, or max a month and nothing in their literature clearly told you it was an annual obligation. As above get them to prove you clearly and knowingly took the 'service' for 12 months.

            What do online T&C's state if you registered that way, or get them to produce the phone transcipt etc to show you were warned and so on.

              Thanks for the input Ed, you are quite right, they do advertise these things on a 'per night' or 'per month' basis.

              I think i shall ask them for thephone transcript, that should be a laugh!

                It's worth a try for extra ammo. I got Setanta Sports to fold on the issue of no annual contract, monthly fee and it said nowhere you had to have it for a month before giving a months notice to cancel so in effect they were selling a two month contract without advertising it.

                They then referred me to their T&C's and not only did it not say not, I taught them about unfair terms and what should've been a refund of £19.98 ended up being £80 odd quid.

                So I'd definitely say it's worth it here. I've certainly never seen anything about an annual contract on channels like that, the impression they give is you can take it for a night to test or sign up for a month. So I'd definitely go after that angle.

                If you argue every tiny point aswell, they may decide to wipe it just to get rid of you. Companies like that don't fancy spending hours dealing with complaints, I would imagine very little goes into admin, as the money goes on the films.
