  • I spoke too soon!

To quote myself from PKea's Robinson Way thread
I've never had to deal with RW but read alot about them,
I had a surprise this morning when I opened a letter from them!! LOL.
It's regarding a debt that will be statute barred at the end of this year. Does anyone think I'll be able to sit tight for another 7 or 8 months without RW doing anything except threatening me with court?

They've given me 7 days to pay up.
You can't scare me, I have children.

What have they threatened to do after the 7 days? 'prepare documents for court' ? Also what is the debt for, how much etc ?

LOL yep, I was jealous and wanted to join you in the RW club

I think it was a catalogue debt, it says KAYS as their client but I don't recall having a catalogue with them. The amount is just over £450 and I've not heard anything from anyone about this since at least Nov 2002..on checking my credit report a default was recorded in April 2003 by Shop Direct which is the same amount, so I gather it's the same debt.

In their letter (formal demand for payment) they state they will take court action if I don't pay in 7 days. I will scan it in later, when I have more time.

          Re: I spoke too soon!

          I would send the,
'I do not acknowledge any debt to your company, provide proof of the ALLEGED debt' letter

They wont have anything, because I bet you never signed anything CCA related.

BUT they WILL battle with you and they dont give up easy

Thanks for the info PKea...I'm used to long battles with a certain other DCA so am quite willing to slog it out with this lot
Will send the 'I do not acknowledge' letter and see what they do next.

This is what they sent me:

As of yet, I've not sent RW anything, received this letter today, think they are fishing....it wasn't even addressed to me, just had my surname on the 'name' bit and I've not returned any post to them!

If they continue to harrass, i would through a CCA request at them - I've found that usually shuts them up.

They will then argue that the CCA 1974 doesn't cover catalogue accounts, but they are taking bowlarks.
