    Nelly yes CCCS is free. They make their running costs by holding your money for 14 days before passing it on to the creditors.

    Well thanks for that Ame, thing is Monument rang the lad this week and said they had not had their money. I know he paid cause we keep all the receipts.
    When they rang monument said they wanted 1 percent of the outstanding debt per month and they would be happy.
    Anyway I told the lad to speak to CCCs as it is in their hands they have had the money.
    Course the lad didn't, today had a letter from monument saying Final Demand for full amount or it is Court or they may decide to send debt collectors round.
    don't know who hubby will kill first debt collector or lad, what can I do please, or should I say what shall I tell the lad to do? Thanks Enaid x

    OMG Enaid,

    I thought once you put it into the hands of CCCS then the creditors had to contact them and not your lad (well that's the way I thought it worked) and you don't have the hassle of dealing with them any more. Sorry I know that's no help to you I am sure it can all be sorted. :hug:

        Ok Di the first thing you need to do is to get your lad to sign a letter giving you permission to talk on his behalf as he is so shyte at doing things.
        Then you call CCCS and tell them whats happened and you also call and write to Monument telling them the debt is in CCCS hands and to take it up with them why the debt is paid late. Oh and make sure everything is done recorded delivery hun.

          With payplan you send any corespondance to them, that you recieve.

          It does sound like a standard letter though, probably will get a few like these as they now know they have their payments limited.

              Hi Enaid, alot of DCA's threaten to send collectors to the door and most of the time they are empty threats in an automated letter. However, if they do send someone round you have every right to tell them to leave. They have no right to come to your house unless they make an appointment with you first. I keep a copy of this by my front door but so far have never had to use it.
              There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and if you do so, then you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.

                    CCCS doesnt mean the creditors stop contacting you with problems, they still do, just it should abate if they are getting their money. Monument may not have agreed to the payments put to them by CCCS so yes first thing is contact CCCS monday and see what the situation is.

                        Hi there,

                        It sounds like your son has recieved a typical collection letter. These are just sytem generated letters that are sent to people that have defaulted on payments. Unfortunately a DMP doesn't mean that the creditors cannot contact him any further. However we tend to find that the letters die down signficantly once the DMP has been going a couple of months and the creditors or DCA's understand that they will not get any extra money each month.

                        They don't have any ability to send baliffs round, and very rarely will they send someone out to collect money at his door (it's not a cost efficient way of recouping debt). Tell him to stick by his guns, and if they do contact him I would suggest that he explains he's on a DMP with the CCCS, and if they want to discuss the situation further, they can give us a call.

                            Dear Sir/madam,

                            Having sent you a letter re telephone harassment on the 30th Jan 2008 and having received a reply to this letter from yourselves dated 5th Feb 2008. The contents of which contained an apology and some advice on how to deal with the fact that I am in financial difficulty. You advised that I may get in touch with CCCS re my situation. This I have already done and have in fact been in a DMP with them for the past 4 month.
                            I have also been in touch with them re your telephone harassment that is still continuing.
                            They have advised me to tell you that I am in a DMP and for you to get in touch with them about this if need be. My mother also told this to the very nice young lady who rang this morning and advised that she would ring again in half an hour as I was unavailable to take the call. The very nice young lady said she would not in fact call CCCS.
                            On 3rd April 2008 I received a Final Demand from yourselves and that you are considering sending a debt collector or even taking court proceedings against me.
                            I am just now writing to let you know that neither of these actions will bring fruit, as you can not get what I haven’t got.
                            I hope this helps clear the matter up and I will continue to pay into my DMP as advised.

                              TBH You just need to tell them that this is being dealt with by CCCS and any further telephone calls will be reported.
                              Less of the nicey nicey approach is required, as they most prob will ignore the letter anyway.

                              Did CCCS not give you a standard letter to tell creditors to contact them?

                              Hang fire on this letter and we will cobblew something up a bit better for you
