started a topic Cabot Financial UK Ltd

    Cabot Financial UK Ltd

Further to the numerous queries on the validity of Cabot Court Claims.
    I have been advised that:
A firm may operate as an " Authorised Representative" in an arrangement
with an " Authorised Firm" ( The Parent Company) to act as an Authorised
Representative before the end of the application period.
I have now asked if this is the case with Cabot Financial UK Ltd and if the
claims issued prior to the Company's Interim Permissions Lapsing.
My feeling at present is that this is what is happening

A Licensed (FCA) company can use " Authorised Representative " appointed to deal with accounts on their behalf.

If they have discontinued then the stat barred period continues running as if the claim had never been brought. I do have a reference for that I'll dig out later.

Also they could come back but as they discontinued AFTER a defence had been entered they would need permission of the court to bring a second claim based based on the same cause of action.

Can they come back at a later date with a claim from a registered arm of their business, or if CF (UK) Ltd registers? I ask as my partner has a claim against her at the moment.
Also someone please advise, if a discontinued claim resets the SB period.

Didn't fancy a hearing on whether they were breaking the law or not then !

You said a hearing in 3-4 weeks, have you received an order from the court yet?

Not as of yet. The judge made a verbal order to submit witness statement with mention of judgement (Hicks v Walker and Reynolds) by 23rd Nov 2015. I am not sure about the next hearing date, but I expact it around 14 days from 23/11/15.
