    Hi All,

Having some issues at the moment in general and looking for a bit of advice. I've been told to contact the CAB but several people now have told me they're not that useful, which isn't very encouraging.

Basically I've been off work since April with relapsed Leukaemia, I've now had treatment consisting of several rounds of chemotherapy and in November I had a Bone Marrow Transplant which I spent a couple of months in hospital for. Slowly I'm on the mend and things are looking good.

My job has been kept open, my employer has done everything they can to help me out so far and been very supportive (I work for a Uuniversity). I was paid full pay for 4 months and half pay for 4 months and unfortunately now I am not getting paid at all. I have also used up all my SSP and am entitled to Incapacity Benefit apparently. This was the case as of October but due to me using the online system to apply for it (and being told a few weeks ago didn't work, how helpful) and being in hospital right up until after New Year, this has only just gone through.

I am over my overdraft and last months payments for pretty much everything bounced. I have several creditors, a couple of loans and a couple of credit cards, who are now starting to shout quite loudly. I have spoken to most of them now asking for a bit of breathing space with varying levels of success. Some are very helpful and some aren't very interested.

My bank, HSBC were the least helpful of anybody. I went in to the local branch after finding that you can't phone your local branch only a call centre, to be told they couldn't do anything at that level and to speak to their Debt Counselling service. I phoned them today and spoke to a foreign based call centre and a lady who had trouble understanding simple English. Her advice when I told her I was off work sick and not being paid was to, and I quote "get a part time job". I was absolutely fuming.

I am hoping to return to work within 3-4 months once my recovery is on track propely, the specialists advised me that 6 months from the transplant was the time to expect to return but due to some complications I'm thinking it might be a bit longer. I'm seeing the doctors again tomorrow so will try and find out a bit more, but unfortunately it's one of those things that might be hard to put a date on at this stage.

What I need is some help and breathing space in the mean time, but I'm finding it hard to work out how I get this. The benefits I'm receiving are next to nothing, especially when I've got commitments that usually rely on my usual income.

Any advice would be great, I'm currently feeling very stressed and worried about this, and it's doing my health no favours at all

    Thanks,

    Mark.

Have a look here http://www.legalbeagles.info/forums/...ead.php?t=1046 for some letters you can send to all your creditors.

Do you have charges on any of these accounts? I would imagine you do. If so, start the ball rolling on reclaiming them and that way your account is in dispute and they cannot hassle you for repayment.

Can you use another account for your benefits to be paid into so that they are not swallowed in charges?

If you send them the/these letter(s) it will give you the required breathing space.

You could list all the creditors out if you like and we will try and get them into some order of priority for you. PM if you do not want that information on this thread.

      Re: Debt worries

Hi Macca, oh I am sorry to hear that you have bee poorly, and am also very glad that you seem to be well on the road to recovery.

Firstly the best bit of advice I can give you is don't even bother talking to people at foreign call centres, do everything in writing. There are lots of letters here Debt Template Letters - Legal Beagles that can be adapted to suit your needs.
Also make up an income and expenditure sheet and show everything that you have coming in and going out, and make offers accordingly.
If you have letters/certificates from the doctors/hospital you could also enclose copies of them to back up everything you are saying.

If you need any further help please don't hesitate to give us a shout.
Most of all try not to worry, I know its hard but it will get better eventually. We are all here to help and support you as much as we possibly can.

        Re: Debt worries

Thanks for the quick replies. I'm trying not to let it get to me, but they're such hard work to deal with it just stresses me out. I feel like I'm doing the right thing by trying to talk to them and explain and it's frustrating when they won't help. I thought they had some kind of duty to try and help you in situations like this rather than making things worse.

As for charges, yes lots and I think on every one of the accounts now.

I do have another bank account, but unfortunately the payment for benefits dated back to October has been authorised on my usual bank account so this will swallow up the payments with quite a lot of charges. I didn't think about this when I filled out the forms.

The foreign call centres are a joke, as is being unable to speak to your branch directly. As far as I'm concerned, HSBC can take a long walk once this is sorted out as I have no intention of ever using any of their services again, it's disgusting.

I'll have a look at some of those letters, thanks. Do you think my best course of action is to just go for a charges claim against them all putting the accounts in to dispute or to try and explain what is happening to them with my illness and go for reduced payments for a few months. Obviously at some point, I'll want to claim the charges back anyway.

I've already claimed charges from HSBC on two occasions previously (a while ago now), you'd think they'd learn wouldn't you..

I can appreciate how difficult it must be, especially with everything else you have to deal with at the moment, but I think Sapph is right and you shouldn't waste your time with call centres, it will only serve to frustrate you further.

Do you have your statements? If so, get started on the claims.

Could you move all the existing DDs and SOs to another account?

I would do this rather than trying to rationalise with them in the first instance.

Definately try and do that - also try and list what ones you have charges racked up on.

You should probably get things in some kind of order and work through methodically.

              Re: Debt worries

It might be worth giving the Benefits agency a call and asking them if there's time to change the bank account your benefits are due to go into. If it hasn't already been done, they may be able to stop it then send it somewhere else. i did this a couple of years ago with my Family Allowance when i knew it would get swallowed up in charges and overdraft. they were very helpful.

on a slightly different note, My cousin had Leukaemia and he spoke to Macmillan who helped him claim all the benfits he was entitled to and spoke to his banks etc and put repayents ect on hold. They helped him sort everything out money wise, he had previoulsy spoken to his bank and was dismissed out of hand.

Thanks for all the great replies guys I'll phone the DWP tomorrow just in case there's time to change the bank account over, worth a try I guess though I think they said when I spoke to them that the instruction had already been sent. We'll see.

Mochamoo, thanks for that tip also, I'll make them my first point of call and see what they can do to help

Really appreciate this everybody, thank you!

Please if you havnt already done so apply for disability living allowance and mobility allowance...........My hubby had the big C and although the forms are daunting I am a dab hand with them(PM me for my email addy and I will hel pyou with them) The number for DLA forms is 08457123456............if you ring them asap they will backdate your claim from recieving your call...............One very important thing to remember is when you fill in forms tell them what its like on your WORST days..............it can take a while but if your claim is successful it opens the door to housing benefit and council tax benefit and also free prescriptions etc etc.............Also DO speak to Macmillan nurse they are fantastic............And lastly Macca............Good Luck.............I know what a rough old sh!tty road it is and really do emphasise with you.........
