    Hi guys sorry for adding a question onto an existing thread but it's kinda linked.
    I had a default in 2004 I never new about it until a few years later but I was now married and determined not to pay for something my ex did albeit in my name. My default was for 3346 and should have been removed from my credit report in 2010 however Lowell have re registered the default in 2012 is this against the law? And can I get it removed?
    this is also putting my mortgage in jeopardy and as I've already agreed to the sale of my house this would make me and my family homeless.

    any help would be massively appreciated.

            Not a problem. Please let us know how you get on and if you need help dealing with Lowell. You haven't had a repayment plan set up with them or anything? If you haven't had contact with them, acknowledged the debt or paid anything for over six years the debt would be statute barred anyway.

              Having spoke to James he said the account defaulted in 2010 now I can't see far enough back but I believe 1 of 2 things happened.
              1) I'm pretty sure that the Lowell account was put in default in 2004 when they took over the account they have then re registered the default in 2010 which I believe is not allowed however I can't see that far back to confirm it.
              2) the original account was put into default in 2004 then Lowell have re registered the debt in 2010 which I also believe is not allowed.
              am I correct or have Lowell lawfully manipulated the system? If this is the case then surely companies would just pass people round after 6 yrs to make sure it remained.

              from reading a article on the ICO website I think this is wrong but would love someone who knows a bit more to help me out here

                Do you have any evidence of the default from 2004? ( What was the original account ?)

                Often when a company like Lowell takes over an account they will change the details to their own but the default date should stay the same, you can only default once.

                I can't think of anything that doesn't take far too long for your situation other than dealing directly with Lowell and asking them to remove it. Collecting the evidence through Subject Access Request, making formal complaints and going through the ICO will take a good three months at least.

                    No but James said the default was recorded as 26/4/2010 but in January that year I got a mortgage with HSBC and the default was on my account and it's the only bill I've ever had that I've not paid.
                    My concern with contacting Lowell direct is I'm not entirely sure where I stand.
                    What would I need from them or need to do to get to remove it?

                      In January 2010 you got a mortgage and the default showed on your credit file at that point ? Did this cause problems with getting the mortgage, any paperwork about to evidence it ?

                        I got the mortgage but very nearly didn't, now however a default is an automatic no you can't even get considered. In terms of paperwork I have to be honest I'm terrible every year it takes me a day to find where I put my mot so I can tax my car I definitely wouldn't have anything from back then especially as I would have de cluttered before I moved in

                          First and foremost, write to Lowell asking that they remove the default as it occurred in excess of 6 years ago and should therefore not show on your credit file.


                          If that doesn't work (come back for more advice, but...), best starter is to get the proof together that the last payment was in excess of 6 years ago - write to the original creditor and ask them to send you a full payment history for the account, you can do this for £10 under Section 7 of the Data Protection Act.

                          Then write to Lowell showing the proof of the age of the account, stating you will take action unless they remove the invalid default

                          Its also important at all times to place something like

                          "I DO NOT ACKNOWLEDGE A DEBT TO YOU OR ANY RELATED THIRD PARTY" just in case they try to start inventing anything else

                            I have typed up an email to say the following I would just like someone to glance an eye over it before I send it.

                            dear sir/madam

                            i have recently checked my credit report to find there is a default from your company.
                            having spoken to the information commissioners office advisors from experian and taking legal advice this morning. I would like to request this default be removed.
                            On my credit report you have registered the account and defaulting in April 2010 however that is inaccurate as I'm sure your records will show.
                            i'm sure your aware a default can only be registered on my credit file for 6 years that time has now substantially passed. On this instance I will assume a clerical error rather than a deliberate manipulation of the system and expect to see it removed immediately

                            i would also like to make it clear I do not acknowledge a debt to you or any related 3rd party.

                            is this the kinda thing I should be saying?

                              Hey so there are 2 illegal marks from Lowell on my credit report, I have no legally binding contract with this company their for these two markers on my report or illegal markers. I'm currently loooking for some advice can someone give me a message please. This is causing me serious distress and harm to my financial future and life.
