    I have sent an application to amend my Defence as in withdraw it. I have made an offer of repayment barring the small amount of charges on the account. Hopefully,the Court will set the installments to what I can afford.

    My application to amend has not been addressed yet, the notice I received today is for CL Finance hearing of their claim.

    For the record, the hearing is for 90 minutes to hear the claim. The DJ has said CL Finance pay £50 for this.

    I'll post up with the next episode.

        Update.

        Haven't been able to update this as I have been in hosp and then my computer got sick as well.poor thing. I'm fairly recovering so hope I can bring this thing up to date.

        I sent in all that was needed for the redetermination and my offer of £5.00 per month. The order came back for £5 per week. I was still in hospital though and it didn't really sink in until I sat and went through everything to catch up on.
        I have spoken to the Court today and they have said I must fill in a N245 and ask for a variation on the repayments. So thats my weekend covered.

        I bet CL Finance thought it was their birthday!!

        How could the court misread monthly for weekly? Is there any way they would reject my offer?

          Hi Sara, sorry to hear you've been in hospital, but glad you are on the mend xx

          The courts normally only order you to pay what you can afford, and I would think as long as you have shown them your incomings/outgoings and £5 pm is all you can afford then they should surely set your payments at that amount. They can't have what you haven't got. It is possible they may have misread, keep up with the good work and good luck with it all

            Yep redetermination on the N245 - there will be a £35 court fee, but you can complete the waiver of fees form EX160 and you shouldnt have to pay anything.

            Should be pretty straight forwards for you, but if you need a hand just yell

              Have followed the same procedure as before with a nice letter to the Judge also.

              Hospital thinking of getting me fitted out with some sort of balloon catheter for me old ticker, but for now I got this warfarin helping out. Of course I assured the docs I manage to get plenty of rest with some exercise thrown in. So I ain't letting these bloomin creditors throw their weight around anymore, specially when they are already drawing blood from this particular stone!!

              Oh I did mention that my hobbies include messing with my computer on this site. I told them what it was all about and interested quite a few folk.

                I bet there are loads of hospital workers in need of a bit of debt help, after all they dont get the pay they deserve imo Enaid x

                  You're right, almost everyone i spoke to was more than interested in the site. Some were really unaware that bank charges etc could be claimed back,so I'm hoping to see some of them on here, Doctors included!

                  Got my papers off to the court so hopefully I'll get a positive response, I also sent off another £5 to CL Finance.

                      Good evening all.....

                      Just a cautionary word....KEEP A VERY CLOSE EYE on C L Finance and H Cohen, I didn't,.... and they got VERY close to a CCJ without my knowledge. repeated failure by them (CL and H Cohen) to provide required docs under CCA.


                      You just cannot be too careful.....!

                          Last post was 2008 so I would assume that amounts owed and the court details given are sufficient to identify them. Furthermore, if a balance is outstanding, then it is doubtful that they would want to gain info on them.
