lowells very old very vague debt

  • lowells very old very vague debt

    hi in jan I got a letter from a well known debt collection which was bought from from a company called hfc its for 2000 pounds
    the debt is nearly six years old and goes statute barred in a couple of months what should I do , how long would it take the debt collectors to get a ccj , I do not know what the debt is for it does not go into specifics and lowells cannot seem to tell me

    Hi, and Welcome

    Did you have a debt in the past with HFC ?
    If so when was the last time you acknowledged or paid anything towards the debt ?
    Have you checked your credit file to see if the debt appears on there ?
    Did you send a formal request under the CCA with £1 fee for your credit agreement or just request it by phone?

    ''I give the wrong date of birth on the data protection checks '' - means they probably don't have your DOB and are just going through the motions - bit naughty (of them, not you )

        they offered to send the credit agreement over the phone , I recoreded the conversation I have never had a hfc account at all

            If you don't know what it is for, how do you know it's statute barred in a couple of months? Under what evidence?

            In terms of getting a CCJ, the time limit they have to work to is getting CCJ claim/application form received by the court inside the 6 years, They don't have to get the actual CCJ awarded within the time limit, but just get the initial application into the court's hands.

            However, if they are struggling to even tell you what it is for or give details of the debt, they would be daft to try court action at this point. Sometimes debt collectors do do daft things, but usually when it's going to cost them court fees they do apply a slight amount of common sense.

              Send them a CCA formal request for the agreement. (look in the links in the 'Library ' bit of the forum)
