  • What happens next? bryan carter solicitor /lowell portfolio

    I recived northhampton CC forms BryanC are acting on behalf of lowells for a debt i owe, i admit to this debt and have filled in the income and expenditure with an offer of a £1 a month and sent it to BC recorded singed for.

    what i want to know is this
    1. Is there anything else i should have done Ie i read on here something about going on to the internet and aknowlageing the claim do i have to do this? or is this only if you a going to fight it?

    2.If i have done the correct thing what happens now? what is the process?

    any anwsers would be great.

    CAB are currently prepareing a DRO for me

    Complete the form on https://www.moneyclaim.gov.uk/web/mcol/welcome - you can admit and offer to pay with your IE form on there too.

      Have i done the right thing? it said to send form back to BryanC and not to the CC do i have to notify Northhampton CC that i recived the forms or have i done it right?

      I have severe mental health issues and this is really stressing me out.

        I would complete the court forms with the same offer you made to Bryan Carter so everything is above board.
        Did you talk with CAB about the court claim when you talked about the D R O?
        All that will happen now is you will get a judgment order from the court which will tell you how much to pay. If this does come back different to what you can afford then you can ask the court to change it, just post up the court letter on here when you get it or take it into CAB and we or they will help you.

          Thanks for the advice Amethyst CAB have been prepareing my DRO for nearly 8 weeks now the hold up has been obtaining the credit report apparently my CAB have been experianceing problems with experian so hopefully i should here something soon,

          As for the County court paper i sent back to Bryan C the income+expenditure+offer one i havent heard anything from them since amazeing really to say all the pressure they have put me under and the constant harrasment the real urgency i thought they was going bankrupt or something lol.

          Does it usually take along time after handing this paper to them? do they now submit it back to the courts?

            I'd give Bryan Carter a ring and see what they are doing.

              I registered with moneyclaim and then it gives you the same options as on the claim form more or less you know defend, defend part admit etc
              So i clicked on the admit one and it just advises you to fill in the income and expenditure then return it to whos ever adress is on the claim form which was bryan c.(you cant go any further on the screen.)
              Theres no mention of acknowledging anything just if you admit to the debt in full fill out the form in the response pack and send to carter which i did registerd recorded.

                      I received a letter of Carter today and it says the repayment amount will be subject to review at our clients discretion.

                      Can anybody explain how this works? i thought i had already come to a repayment agreement through the courts with the CCJ?

                      If they want to change the amount i repay again do they have to apply back to the courts for me to resubmit my financial details?

                      Will this mean more money is added to the debt?

                      can anybody tell me what the process would be?

                      Also just as a quick update im still waiting for CAB to do the DRO i went in a couple of weeks ago and they said i was next on the list it has been months now.

                        Indeed, if you have a CCJ, the court would have ordered you to pay a certain amount every month.

                        Yes, they'll have to apply to vary the terms.

                        No, it shouldn't increase the debt, they are just looking to increase the amount you pay every month. It shouldn't put you over the limit if that's what concerns you.

                        If you are going to do a DRO this debt will be included and you won't have to worry about it. :thumb:

                          Quick update still no DRO yet also my partner has just started work how does this affect my debt? i have asked here if she would contribute anything towards it to help but she says she wont help pay for debt incurred before she met me when i was in another relationship she said its not her responsibility..

                          Does anybody have any advice?

                            This is a debt in your sole name so there's no reason for your partner to contribute towards it. The judgment was only obtained against you not her. I'd just keep paying what the court ordered. :thumb:

                            Do you still think a DRO may be the best solution? Are your other debts also subject to CCJs?

                              FParrot thank you so much for your bits of advice over the months my downward spiral started with the end of my marriage coming home from work to find my wife gone and never to be seen again, then the mental health problems started severe depression and anxiety along with been made redundant (i now know the bury the head in the sand technique never works) the constant harassment ant threats have nearly drove me crazy.

                              Stupidly i based all my credit decisions on the fact there would always be 2 wages coming in all the debt was in my name, i have started to get better (most recently when i got the CCJ it took away the fear factor) but i feel the DRO is the best way forward for me i want to resolve this and try and move on with my life and i can honestly say one thing I WILL NEVER TOUCH CREDIT AGAIN, CREDIT HAS NEARLY RUINED MY LIFE.

                              Will the DRO be assessed purely on any income i have ie Child tax credits, child benifit etc because i look after our child?.
