    Hi,

    The HFC account was a High street unsecured loan that i took out in one of thier branches when they were called Beneficial bank, that was about 20 years ago, i know regular standing order payements were still going out as recently as early last year.

    The orange contract was taken out in 2008 but i only had it for about 3 months then i decided to cancel it and i returned thier mobile device in the post to them, i assumed they would have just killed it off and ended the contract due to the short time i had it for.

        Today i recieved a letter from Hampton Legal solicitors regarding my orange bill, i refered them back to a letter i sent to lowells as i assume they crossed in the post however as they are surely one and the same company - perhaps they were just trying it on with me suggesting an early settlement saving me 20% (yippy) and in thier words saving me a CCJ i diddnt think people on a dissability benefit could be thrown a CCJ?

          Anybody can have a CCJ against them, the only difference is that, if you are reliant on benefits, you'll probably end up paying just £1 a month. Even a court can't order you to pay what you can't afford. When you get a CCJ you'll normally be expected to submit an income and expenditure form.

            Seems realy stupid and pointless on lowells side pursuing this, as the bill is only for £50 in the first place, and i have already told them they are only going to get £1 a month out of me anyway, i would have and would be more than happy to pay orange direct instead of lowells but i dont expect they would be happy to, or even pay lowells the price they paid for it off orange, i bet it wasnt £50?

              With the orange contract, i took it out 6 years this june/july and never had any contact with them till lowells communication about 2 months ago, so could get statute barred - couldnt i?

                No, as you seem to have acknowledged it in writing.

                If you did not tell them in writing that they'd only get £1 per month, but said that by means of the electric telephone, that wouldn't count as an acknowledgement.

                  In that case, I very much doubt they'll issue a claim, since it would cost £25 to issue a claim through MCOL. :wof:

                  Although it's not usually wise to ignore, given the amount involved I would be inclined to ignore them in this instance. I have received several letters from AK chasing £50something which I've ignored and they haven't bothered me again. There's only so much ink, paper and postage they can waste their money on chasing a debt that size, when they can spend exactly the same chasing one 100 times bigger! :wof: :wof: :wof:

                  No, more likely to have been £5. Orange would have written the debt off as a tax loss along with thousands of others offloaded to the Leeds Losers at the same time.

                    Just to bring things up to speed - i heard back off lowells again about the CCA i sent them, and again same reply about them sending off and me having to be patient, also got a reply about my orange bill and they gave me a few strange dates and last payement orange had told them, but this date does not tally up with me - wrong place wrong time etc, also they reminded about the third debt they have on me an old home shopping debt, this has jogged me on to send them a CCA copied and Bold written again.


                    The first CCA i sent to them has now gone over the 12+2 days for a copy of my original, does this meen because of the wording in the CCA letter that they can not pester me legaly over it now, as that is what it says in the CCA letter?

                      I would go to the stationers nd obtain a duplicate book. Then each of the hand written letters had a contemporary copy made .

                        I recieved anothe rletter from lowells today in relation to my HFC bank loan, nearly 3 weeks into sending them my CCA request this was thier reply today - We are waiting for your credit agreementI am afraid we have not recieved a copy of your credit agreement from HFC Bank LTD yet. They are still trying to retrieve it from their archives.
