  • Prove it letter

    Hi,

    I have the template Prove it letter as provided, but i dont have a printer and live miles away from shops, firstly would a hand written letter that is worded exactly the same as the templated one suffice, and could i put in with this letter a £1 pound coin instead of a p/o, also as i have their pre-paid envelopes would the prove it letter be ok sending without a proof of posting(i would take a photo of my letter first as proof).

    For the extra money you are much better sending by recorded delivery. Rather than putting a £1 coin in you can put a £1 stamp in the envelope to cover the fee. It does not matter whether the letter is typed or hand written. Although when sending to most DCAs it would probably be better to write in BIG LETTERS with colouruedcrayons

      Request for letter sent to Lowell today, after writting the letter in Block caps and signing off with signiture letters enclosed with brackets, i enclosed 2 first class stamps to cover the £1 fee, before sending i took a photograph of the letter and stamps, then i used their own pre paid envelope and writ on it Very Important Documments Inside, and on the back i put the date sent on it.
      So if they try to say they diddnt recieve it, i can prove sending it by my dated photograph.

        After sending a prove it letter to lowells last week, today i recieved the following reply - We have requested a copy of your credit agreement.
        Thank you for contacting us about your credit agreement We have asked your original lender for a copy together with statements.

        We will reply as soon as we can
        We will do our very best to send you the information you asked for within 12 working days, but this does depend on when your original lender can send it. We will let you know if we do not hear from them in time.

        We're here to help....


        Any ideas what this meens? can they do this if they just brought it the same way as most or could they be dealing with the company direct?

          The Leeds Leeches like all scummy DCAs by shed loads of debts without either checking the validity or status of it. It's only when someone asks for proof that they have to request it from the original creditors

                  It's a standard templated response, meaning they haven't got any information regarding the account and will have to request it from the original lender.

                  You say you sent a prove it letter, but their response suggests you may have sent a CCA request. Which one did you send?

                            I heard back today from Lowells - the same letter as above just telling me they were trying to locate my acount details from HFC/Beneficial Bank, its quite funny this acount i opened with Beneficial Bank way before they became HFC about 20years ago, but due to un employement and still am, they put me on a special support scheme at a very low rate that was just set up over many many years, i moved house seperated from ex and started new life and had to refresh my bank so my standing order with HFC got lost.
                            It wasnt till recently that i found out HFC was not getting paid anymore, it was not a problem as i never noticed the small monthly amount, just annoying and a pain now lowells are on the case.

                            I have also wrote to lowells about an orange moby contract bill, and told them in no uncertain terms - that i will only pay £1 a month towards it If they show me a Truthfull statement and showing the last payement and were it was paid.

                            I am due to send a CCA to them on return of post for a catalogue bill dtaing from 2008 as like i have said a payement was made of £40 on it in 2010 and not by me as i had left were i was living and lost touch with them.

                              Could there have been 6 years with no payment? Was this a current account overdraft? Because the usual CCA request wouldn't apply if it was.

                              If you opened the account only in 2008, it wouldn't yet be SBd, even without a 'panthom payment' in 2010. Also a response to a CCA request is meant to include a statement of account, but not necessarily all statements. For historical data you'd need to send a SAR, but that would cost £10 + postage. In the end, once this is due to be SBd, it will be up to *them* to PROVE that you did, indeed, make such a payment.

                              I see a pattern emerging here, where Lowell keep making up phantom payments... :marchmellow::marchmellow::marchmellow:
