    The reason they would get their cut is they collect the money HMRC cannot or do we let those who owe the Country money get away with it?

      Akinika will be on more than 10% more interestingly the HMRC have just sold a huge amount of student debt, so the position is changing. Under the OFT debt collection rules they cannot refuse a payment, its similar to the position they may want more but cannot refuse the money offered. Akinika may well be in breach. If the position is the HMRC is refusing the amount they should refer the file back to them to avoid a breach.

        Just had a text from these guys akinika with a reference.

        I phoned back, gave my mobile number as I was phoning from the phone that had the text reference on it....

        I couldn't confirm my address to their satisfaction!! They must think I was born yesterday.

        Anyway, I then said that could they remove my name and number from their records, she said yes - of course 'bloodsuckers like akinika are not likely too'...

        But my thinking is that if they are happy to remove me from their database, then they could only have been fishing in the first place? Maybe I am wrong, but if they really were chasing a debt in my name, they surely would not have been so happy in the acceptance of removing my name!! And would have sent letters chasing debt....

        And if they don't I will think of something else to say/do

          The DWP and HMRC use debt collection agencies to pursue overpayment, tax debts etc., The DCA's are fully authorised and audited by the government departments and are signatories to the OSA in the same way as civil servants within the departments.
          Letters and methods of contact are those approved by the department.
          Mostly the DCA's are chasing quite debts where court action is no longer available.

            Does that mean they missed out on Court Action, or they never bothered?

            Shouldn't any debt be letter driven, and not 'text driven' and when asked to be removed, shouldn't the DCA say that they will write a letter? as 'texting' hasn't worked.

            Unless of course telling the DCA to remove me is now a defence against debt!! If there was any in the first place.

            No I think I will stick with the view they are a bunch of wonkers just chancing their arm!!!

            no doubt there has been some form of debt chasing put in place by HMRC, but they are equally inefficient and the MPs/Civil Servants that manage them really are incompetent, if not just daft!!!

              The " Government " debts become statute barred in the same way as other debts BUT the law allows Government departments to pursue debts (short of court action) indefinitely and can gain an attachment of earnings order without recourse to the courts.
              Governments debts as said can be pursued how ever old they are and DWP debts can be deducted from current and future benefits including state pension and pension credit.
              HMRC has far reaching powers now to recover debts, the use of 3rd party contractors is just one of them, the only certainty here is that they wont give up.

                Great...But they still have to write to you!!?

                And they cannot rely on test messaging only!!?

                And they cannot rely on me/punters failing security when you do phone!!!

                Therefore the debt doesn't exist, and the DCA is just fishing!! As I said before a bunch of wonkers.

                  How on earth do you come to the conclusion that the debt does not exist?
                  The DCA will have been provided with all the relevant data by HMRC and will use authorised methods
                  of pursuit to collect the debt.

                  Court action is not available if there has been no contact/payment/acknowledgment for 6 years, but as said HMRC can and will pursue for payment however old the debt is.

                    How on earth do you come to the conclusion that the debt does not exist?

                    I struggle with how the public is ever meant to pay debt with more debt?! -4 + -4 = -8

                    Since this is the logic currently employed in an attempt to pay off portions of the national debt it certainly explains why it has doubled in just the last few years.
                    By using promissory notes (instruments of public debt) to attempt to PAY public debts will only ever resut in more debt.

                    I have had a text and phone call from Akinika today over a matter with the DWP. The DWP have been sent 3 cheques to discharge the liability they speak of, and certainly appear to have kept the cheques .......and yet without a word from them they appear to have enlisted the services of Akinika to extort yet more money in an attampt to further inflate the national debt and earn some frraudulent gains for themselves in the process.

                      You would be better spending time checking on your alleged payments and seeing if the cheques have been cashed rather than hijacking this thread for a rather pointless rant.
