Re: Mortgage debt and HSBC help needed

Don't worry. Plan B and I know each other, so I'm sure if she needs any help from me she'll give me a shout. She's very good!

Just to be clear. I have not given the OP legal advice by PM. I never break site policy on this golden rule. :nono:

I'm well known for dishing out hugs to people facing repossession and that's all I have done by PM

The OP has been given until 20th September to respond to her lender and I will equip her with the right legal tools to do that well before the deadline.

Apologies if that's how it came across Plan B - it is not what was intended. The details did not seem clear to me, further details had been pm'd to you as mentioned in post 10. We don't know what all those details were. That's not to suggest for one moment you advised by pm - I know you wouldn't do that.

It's good to know you'll provide the necessary help to the OP. I did tell her twice she was in very good hands, and I meant it. :beagle:

Don't worry there is no protocol with me. What you see is what you get

I know how you feel because I have been through the trauma of a suspended possession order which can be very unsettling. Give me a couple of days to read what you sent me and then we'll make a plan

No problem. IF you need any help with the Income and Expenditure I run a fully licensed debt charity, so can do a Common Financial Statement for you easily. Just shout if you need me, I'm usually lurking somewhere around.

Re: Mortgage debt and HSBC help needed

You've not taken me up on my offer to talk or email probably because of my crass mistake to assume that just because you brought up your three sons on your own following divorce you must be Mrs Newbie when you are in fact Mr Newbie. To make matters worse you are in the construction business so my previous posts containing hugs and kisses were entirely inappropriate So let's start again.

Over the next couple of days please will you answer my random questions on this thread so we can get a strategy going before 20th September when HSBC will be calling you again. It's only a phone call not a bailiff's warrant for eviction. Please do not throw in the towel because HSBC are bullying you. Pure and simple. There are ways to fight this. You have equity in your property FFS.

What I would like to know is this: you have a 'first charge' mortgage from HSBC which is all paid up to date with no arrears (have I got that right?) which will expire in six years. Is this mortgage in your sole name and was it part of any divorce settlement with your ex-wife? This mortgage will expire in six years when you are only 65. HSBC are refusing to extend the term of the mortgage which is probably in breach of Pre-Action Protocol (did they offer you this option before starting legal proceedings?) although an extension could solve your problem. I have mortgages which run until I'm 70 so I don't see why HSBC are refusing to give you this option unless you have known health issues etc. More background please

What I would also like to know is whether the suspended possession order only relates to arrears on your 'second charge' secured loan which is also with HSBC. It seems this may be a business loan but could it be an overdraft facility which has been 'called in'? If it was a loan when was it set up (2008 according to your PM?). More information please.

The PPI issue may well be helpful. Can you tell me more about whether that was only on an HSBC credit card (still up and running?) and/or on either of these mortgages or loans. We have an excellent team on LB to deal with these reclaims which could be make or break with this repossession problem. If you have (and that's not yet established) a PPI refund due from HSBC which could contribute towards your arrears this could (not definitely) be a game changer. You seem to be self-employed which could mean that PPI was a non-starter.

Please get back to me with some answers and we'll take it from there :typing:

                        Hi Di

If we could talk via phone it would be good as I am failing to explain my self and l think it would be quicker and easier for me.
