Under which agreement? The victim of those spivs seems to have had three agreements, each time for more money, with the debt from the previous agreement somehow rolled up into the next.

I will double check with my friend that they did say they were baliffs but I am sure that is what she said cos she asked to see a court order but they just ignored her and kept pushing for the car - but if she confirms that they did mis represent themselves then I will check out the act that you quoted - thanks for helping and the advice regarding TSO it is greatly appreciated

I've had dealings with this car company and their legal bods before. Not a nice company to deal with. I would not trust what they have done. At least they buckled when I used the small claims court.

right I have gone through all three contracts and by my calculations returning interest and unfair charges and mis sold PPI on the first two car contracts by the time they were taking the third car she had paid off all debt owed!! but the points from the CCA you raised sound really good and relevant so I will be reading further on them as I think this might be the way to go - I cant believe the way this company behaved they really rolled my friend over!!

I will tell my friend that it will really cheer her up - what they put her through is disgusting even when they were supposed to be doing an SAR they involved solicitors - which struck me as weird as she had received letters from their litigation & legal dept threatening for money - if they have their own legal team why would they employ outsiders????

this is true - each time she part exchanged a car they just rolled over any outstanding debt that they had on it so I have done the three contracts taking into account part exchange value and also payments she made plus refunding interest and charges etc and by the time I get to the end she had paid all in full and then some!!
