    Re: Welcome/lowells

I have no idea the signature on the form isn't mine and I have never seen it before in my life until yesterday, I think it might have been a loan that my Mum took out in my name that the guy in the branch said she could do.

Other than that I have no clue.

Do you recognize this loan, have you made any payments towards it

Do you know where the money was paid into (bank account)

I SAY THAT FOR VERY GOOD REASONS

        Re: Welcome/lowells

        Hi

No I don't recognize it, and I don't think there was any money paid into a bank account because it say something about an existing loan. very confused, and unfortunately I can't ask my mother because she passed away a few years ago.

Nevertheless shouldn't it have prescribed terms on it? like the monetary amount of the interest paid? isn't it unenforceable for that reason

          Re: Welcome/lowells

There are issues with the agreement that i have spotted. An example will be the acceptance fee, that has been included in the amount of credit. This should have its own set of prescribed terms then placed under a heading "total amount of credit" and not "amount of credit" Or amount of loan, welcome cant even get that right

5 years of repayments for a loan this small has also set the alarm bells ringing

You need to be sending low life a letter by recorded delivery stating the account is fraudulent

They are saying that a cheque was paid at the time of the application, you need to be demanding a copy of that cheque and where it was paid into

If the agreement is a rewrite, the agreement should state, agreement to vary the original agreement xxxx

Certain creative accounting measures were endemic at one time within welcome finance to meet performance targets, that is a matter of record, but without the means to substantiate that at the moment, i will do some more digging for you

            Re: Welcome/lowells

Ok, thank you, is there a template letter I can send to say the account is fraudulent, and should I continue with the SAR to Welcome.

There is also no total charge for credit or loan, and no box containing details of cancellation rights.

                  Indeed.

When was the last payment made and when was the agreement defaulted/terminated?

                          By whom was it made?

If the last payment really was made in 2008, it hardly matters.

                          When did your mother expire?

It would certainly present difficulties, not least of which because the spirits at seances only seem to talk about the weather.

Who was the executor of her estate?
