  • Cap quest! Help please

    I have just received 3 letters from cap quest saying I owe in total nearly 10,000 to a bank I haven't acknowledged any debt for about 3/4 years this is the first time I have heard anything from them I have mo ed 2 times in this period do I contact them and say I want proof! I was hoping to get it to a period where it became statue barred but don't want debt collectors at my door I live alone with a 1year old any help or advice would be great plz

    I would not worry about it just yet once all the guy's on here come in and give you the advice you need you will feel better about it. Sticky was really good with me he helped me from the start with his dealings with DCA's. Ive managed to hold out for 6 years with his advice and mine go Statue barred tomorrow. Good luck.

        Sorry Nic a lot going on at the mo on Beagles and as it's all in the open now if you have a read about you will see what I mean.
        Anyway that doesn't help you does it? and I am not the one who can offer you advice on this but please have a read on here

          Hi try going to dealing with DCA's and have a good read there Sticky is great and will really help you Im not the best person to help but I really dislike these DCA's the advice from me is do not phone them or talk to them in person, never say you owe them money, if they keep phoning tell them if they keep doing it you will report them for harassment and also you do not want any visits its not allowed and tell them to contact you only in writing, then you have a paper trail to look back over.

          Then get on to dealing with DSA's and you should be sorted out in there good luck.

            Remember everyone on here dislikes DCA's and Cap Quest is one of the worse so don't panic and help will come soon from someone.

                capquest like most dca just want you to phone them to begin with . this is to get you to acknowledge the debt

                if this is the first time crappyquest has sent you a begging letter then i would ignore as they are no more than a phisshing trip to get you to bite.

                remember, a dca can do nothing under the data protection act unless you first acknowledge the debt.

                do not talk to them on the phone or respond to a letter unless they provide more substantive communication

                a dca has no legal powers and cannot send baliffs etc

                so IGNORE for the time being

                  Just had more letters today saying if I don't get in touch by 12th July my account will be passed to H L Legal who are apparently there solicitors help please guys

                    It also says that 'if a satisfactory payment programme is not established and or you fail to comply with our request to contact this firm we will not hesitate to utilise the legal system to the full extent!

                      Ok, so you say you may owe 10k. Some basic questions first:

                      What is the alleged debt for? Is it for bank loan, credit card, overdraft? Who are Capquest claiming their clients are?

                      When was the last time you made a payment towards the alleged debt?

                      Do you live in Scotland/England/Wales?

                        All to natwest bank I think 2 are overdraft and one is a loan it doesn't say when last payment was made but at a good guess I would say at least 4 years and I haven't heard anything I have moved twice in this period I've just applied for my credit report because from other people's threads they seem to indicate that's the best way to find out and to ma,e sure no ccjs have been issued against myself I live in England any advice appreciated I really am in the dark on what I should do

                          Hi all another letter received from cap quest today saying letter of claim under the practice direction - pre action conduct it basically says as a result to my failure to respond we must now consider your account for legal action. My account is being passed through our pre action validations and checks. This includes compiling data relating to your residential and employment status.
                          Any claim will be issued in the name of natwest blah blah then it says we refer you to the practice direction pre action conduct which provides that parties should exchange information before starting proceedings. Paragraph 4 allows the court to impose sanctions on a party who does not comply with it's requirements.
                          Then it basically gives me 14 days to contact them.

                          What I want to k ow is what the heck should I do. Do you think I should ignore it are they going to start court proceedings on me? Would they have to serve me before they go to court kinda worrying here guys

                            if crappyquest are going to use big words such as practice direction, might they even look at the civil procedure rules to start with

                            you have no legal duty to respond as they have not confirmed any assignment yet as to 196 lop act 1925
                            what statutory rights have they to validate employment status ???

                            this is all bovine excrament to get you to respond
