      Why waste the price of a stamp on that? Better to get on to TS, who will themselves contact MH and remind them of the proceedure they should be following; this will also register another black mark against MH in TS's eyes. And if someone is bombarding your house with calls, that is harrassment and needs to be dealt with accordingly. You don't pussy-foot around with these clowns; go straight for the jugular right away and they'll soon quieten down.

        In all harassment cases, especially those under the Protection from Harassment Act 1997, it is a pre-requisite to any formal action that the victim tells their tormentor to stop harassing them. The best method by which to achieve this is a Notice to Desist, basically, a "Stop It" letter. Don't forget that harassment by means of telephone calls and/or emails is an offence under Section 127, Communications Act 2003. So you can fire both pieces of legislation at them. Section 40, Administration of Justice Act 1970 was originally intended to deal with DCAs who harassed debtors, but the penalties available are not effective deterrents these days. The Protection from Harassment Act 1997 and Communications Act 2003 are much more effective. If you need help putting together a Notice to Desist, post up.

        There is also case law in the form of Ferguson -v- British Gas Trading 2009 which holds companies liable for their harassment of individuals and would be useful in firing a warning shot at MH and the OC.

          The simple reason for "wasting the price of a stamp on that" is correct procedure. It's no use jumping up and down and threatening all manner of nasties to MH or any other DCA unless you follow the correct action. If you accuse anyone, DCA or not, of acting beyond their legal power's it does your case no good at all if you do the same in return. After all, are you really going to pursue them to court, do you have the means? Give them enough rope and they hang themselves; you might aswell keep the OFT, FSA, TS and the FOS on your side. Don't you think?
