  • Mackenzie Hall - lying b*stards

    Last Saturday I received a letter from MH stating that I had defaulted on my direct debit payment and threatening legal action. I haven't received notification from my bank that this DD wasn't paid. Also the letter from MH was dated 1 May, which, coincidentally, is the date of all my DDs. I do have an agreement with MH, but for a while now they have been trying to contact me to increase my monthly payments. I have a suspicion that they sent this latest letter in an attempt to scare me into clearing the debt. Well, after reading posts on this website I was reassured and decided to ignore them.

    How can companies get away with this sort of thing?

    Mucky Hall are well known for stretching the truth and overstating their abilities.
    They specialise is unenforceable and statute barred debt and I'm surprised to hear you are paying them at all.
    They are the lowest of the low, utter pond scum..

      I received a letter from Barclays yesterday (although it is dated the 11th May) to my horror advising me that my account has been closed and my overdraft facility removed due to an 'inactivity' on my account - it was only set up for the overdraft whilst I was at University. Now they've 'kindly' passed my 'debt' onto these Makenzie Hall to collect.

      Of course I'm very nervous about this as I can't afford to pay it all off. It's gone from being £500 overdraft to a £700 debt that they are bullying me into paying. My trouble is I don't know my rights and until I googled them and ended up on this site I was beginning to think what the hell am I going to do next!?

      They keep calling me now - I haven't answered but its continuous!!!

      It's stressing me out already and its only been 24hours! HELP!!! :tinysmile_hmm_t2:

        See CB's reply above. This is one Debt Collection Agency that really should not cause stress.

        It is highly unlikely that this would be the first DCA the debt has been passed to, have you had letters from other DCA's?

        How old is the debt?

          No, no other letters this is the first - also the first I knew of it changing from an overdraft to a debt?!
          Who do you arrange to start making payments to? Or dont you?

            Normal practice, especially with Mucky Hall, is to ignore the first letter, then send off the Prove It letter if they write again (see link in CB's signature above).

              Actually BEST thing to do with Mucky Hall is to completely ignore them anyway and save the stamps.
              Talking to them only encourages them

                  That's the basic gist.

                    How many times a day are Mucky contacting you?

                    With overdrafts, as long as you pay something into the account, periodically, you are said to be "servicing" the overdraft, i.e. reducing it. How long had your account been allegedly inactive?

                      Thanks Curlyben. I did get into debt a few years back when I lost my job. When I got another job I wanted to clear my debts. I didn't know then what I know now about these collection companies. If I cancelled the direct debit with MH what would happen?

                        They'll throw their rattle out of the pram and send you some not very nice letters.
                        All in all they'll huff and blow and eventually burger orf..

                          Don't panic: they're only people, at the end of the day. Scumsuckers, though. Whatever you do, DO NOT telephone them!! You need to get in touch with Barclays, though, and find out why they didn't notify you of the closure.

                          Also, report MH to your local Trading Standards and tell them MH is harrassing you. Tell MH this and that if they don't stop, you'll get the police involved.

                            Could i suggest, before you go running to, or threatening MH with, the Police, you refer them to OFT debt collection guidlines. Point out to them in writing you are aware of your rights and the actions MH can, and cannot, take against you. They will laugh anyway and continue with their actions, at which point you can make the appropriate people / licensing authority's aware of what MH are doing. Too many don't report the (unlawful) actions of debt collection agents which is why they continue to get away with it.
