Will lowells or hamptons really sue me, or is it just a threat?

  • Will lowells or hamptons really sue me, or is it just a threat?

    Hi

    Lowells are chasing me for two accounts, one of which has been defaulted.

    They are both for roughly 125 pounds and are both from 2 three mobile contracts, 1 in my name and 1 in my wifes name. And i had disputes with three on the defaulted account.

    I just had a couple of questions. that i hope someone can answer for me.

    • what implications does a defaulted account have.
    • I called them and asked for a full final settlement and a discount, the guy said that he cant offer me more than 10%, so i said thank you for you time and hung up. Is that really their last price? or will they call me back?
    • Will they really apply for a ccj and send bailiffs or is that just a threat.
    • What is the best way to pay as little as possible, or none at all, since i frankly dont care about my credit report, and dont believe i owe them that amount.

    It was a bit silly to be defaulted for £125, its going to last on your credit profile for 6 years and will affect your ability to obtain some credit.

    However firstly;

    1) never talk to them on the phone, letters only, never sign a letter either.

    2) They will not apply for a CCJ or anything with the courts for a debt of this low value, there costs would be more than this balance.

    3) The general rule of thub is the longer you ignor them the better the discount they will offer you, it will eventually end up at around 50% after 6 months.

    If your really not fussed about the default and your credit profile then just file the letters till you get a discount that suits you.

      Thanks a lot for your swift answer.

      Having looked at the papers, its actually 180 and 240 if you include the early termination fee. Is that still to low?

      Is there a possibility they send bailiffs?

      And for the discount will they contact me and offer me the discount or do i have to ask them again?

      and Finally why cant i speak to them on the phone, i'm not keen on sending letters.

        Those values on the type of debt simple would not be worth their while in terms of cost and times to recover through a court, hence 'threat' letters you get are a lot easier for them.

        There is always a possibility, but look at their registered address and then look at yours, if your miles away do you think even a in house bailiff would be cost effective to drive to you and back when you might not even be in or can legally just ask them to go away?

        If i was you i would not even respond to anything, phone calls, letters, e-mails, texts, they will try the lot trust me. If you get bored send a 'prove it' letter and see there response.

        Phone calls can not be recorded your end easily, and they will have no issues simply lying to you on the phone to get you to pay. Letters you have a paper trail.

        It sounds strange, but the best way to handle them is to do the least.

        Read my thread in this forum for the process of what they will offer you in terms of discount.

        It will either be reduced to 50% (or close to) in a 'Final Offer' letter in 6 months time before it will be sold again to another company and the process will start again.

              Yes it is true i think by talking to them you just encourage them to persist.
              On the occaision that i have been contacted by these i usually either refuse to answer the security questions or get them wrong.

              Well that is not what it says here they say, says where i say, cant tell you they say, bit pointless you ringing then i say.
              Are you sure that is your date of birth they say, erm i think i should know when i was born I say.

              Not a lot they can do really.

                  They have send me the 50% discount letter, do you think they would go any lower than that.

                  If i offer to pay them 40% or so right now.

                      Am I reading this right, they have sent you a 50% off letter, yet you want them to go to a lower rate and offer them 40% (you want to pay them if you had to more than they would ask for), why not stop and think and wait for 100% discount before you even think about it, ? why are they offering you a discount?

                          Hi I owe lowell and hampton £530 and now thy have padsed it to Red ,thy said if I dont pay thy will take an action and send me county court judgement or bailiffs im worried would thy realy send me a CCJ or is it just a threat please help

                            What is the alleged debt for. Red are just another desk in Lowells Leeds threat centre. Lowells cannot send Baliffs in. Only a court can and even then Lowells would have to take you to court, win the case and you would have to default on the judgement of the court. There are lots of things to be done befor this even reaches a court

                              Hi and welcome

                              This is a rather old thread so you'd probably be better off starting a new one for yourself. :ranger:

                              They can't just send you a CCJ, they'd have to follow a process, starting with a claim, which you'd have the opportunity to defend. They'd have to win and obtain judgment against you, then go back to the court to apply for a warrant of execution before they can send bailiffs round. As you can see, this is rather a long way away.

                              What's the debt for? In many cases, it would be advisable to hit them with a CCA request, but not if it was, say an overdraft or a mobile contract. We really need a bit more info. :typing:
