Yes i believe they have to if they intend to add interest to the account.

In this case though i think it is just a scare tactic.

They have to, otherwise they cannot add interest and;
the information has to be correct or, their boat is sunk!

Many are now panicking because they had not previously sent out same

Hi again peeps,

ive not had a letter from capquest since 5th of febuary (m butterworth) when they said they would be taking me through the litigation process!
Should i be worried yet or is this a scare tactic?

S611 - Do not worry about it, its perfectly normal for them to send out letters threatening legal action and to then go running back under the stone they crawled out from, as soon as they get a letter in response. Some people don't hear anything again from 3-4 months, and then get another letter similar to the first from either the same company or a different DCA. Others will be waiting 2-3 years or more before they here anything.

If i remeber rightly your debts where over 13 years old though you had been repaying them between 2003 - 2010 via DMP. IF this debt was part of that and the last payment was less than 6 years ago (5 if your in scotland) then although its technically not statue barred, there would be very little chance of them willingly taking it to court given the background, and the fact your its no longer on your credit file, technically meaning your no longer in default, and if they tried putting another defualt on your file it would be libellous.

IF however the debt was not part of the DMP, then its statuted barred and they can not enforce the debt in court, if they tried, it would be very easy to have it thrown out by default judgement.

Nope don't get worried at all, just get on with your life and forget about them - Though stick all letters in a draw for save keeping.

Hi peeps,

lowell have searched my partners credit file 6 times in the last 6 months for a debt that we dont even know about dated july 2000 surley this will be stat barred now!
£300!!
also iv not heard from crapquest for 2 months now..
