Re: Debt in serious dispute sold on

It is definitely an assignment in Absolute.

I do not think Egg would have bought the debt back, especially as they're smack bang in the middle of being taken over by Barclaycard.

I would be inclined to write to them with a copy of the letter from both themselves and Egg, saying it is clearly an assignment in Absolute and as far as you're concerned, given this situation you consider the onus of proof is on them to prove otherwise by supplying you with the relevant Deed of Assignment transferring the debt back to Egg, as they and Egg have given you clear statements saying there has been an Absolute Assignment to Britannica-Arrow.

Thanks. My preference is for Arrow to keep it, as they cannot collect! Besides which, I live in Taiwan now.
      Thanks!

I'd be very surprised if Egg will buy it back as they're sold in bulk. That's why I suggested you ask for the Deed of Assignment which they almost never release. They have, in this case, specifically stated they have an absolute assignment, then specifically stated they haven't. The Deed of Assignment is the only way to prove 100% to your satisfaction.

If of course they now say they have bought the debt, then they have lied in writing to you which opens up a variety of alternate avenues to make them squirm.

Looks like I've won then. Apart from the fact that they cannot collect in Taiwan, I always like to have an escape route in case I come home. Egg have sold off a fully assigned debt, knowing that it was in dispute. Arrow have written a letter to me stating that it is fully assigned. Now Arrow have lied in writing by saying that the debt was not fully assigned to them. Additionally, Egg sh** on Arrow by selling them a disputed debt. Just like they sold another disputed debt of mine to CapQuest, who had to close the account as they were unable to collect the ten thousand pounds from me.

What an enjoyable experience watching them all crap all over each other!
            Thanks!

They are allowed to sell a debt in prior dispute. As far as I'm aware there is nothing to prevent them from doing so and certainly the FOS aren't interested.

OK, but then Arrow can't collect if there was a prior dispute, according to the template "prior dipsute with OC" letter.
                Thanks!

Well that's the basis of my complaint to Wescot. Have yet to hear from 'em.

They are more than welcome to write me here in Taiwan. We also gave refuse reckcing collections here daily, so I can segregate their letters accordingly.
                          Thanks!

Nevertheless DiB, you have quite wisely continued to take an interest in such matters, just in case you should return to English soil. A lot of emigrants do not and probably return to more than a fair few problems that have been rumbling on in their absence. I think that letting Arrow and co know where you are and not trying to avoid them is the best approach and, for that matter, also corresponding with them and arguing your case.

darn good point there Winner! Will it be SB though if DiB continues to communicate with Arrow? Don't know - maybe someone else can clarify that?
