Hi, I really need urgent legal advice, i hope someone can help!
I started a debt management plan with CCCS approximately 4 years ago and have never missed any payments. However one of the creditors, HFO services, decided that my monthly payment wasn't enough and so threatned court action.
I contacted the CCCS and did all they told me to do and sent off all literature required. However, HFO services successfully obtained a CCJ via Northampton Court processed by their bulk centre which had no hearing. The CCJ was for £645 a month. Then, i asked for a redetermination that took place on 19th July and the judge gave permission to the claimants to apply for a charging.
In essence, on an unsecure debt from march until today they have managed to obtain a CCJ and practically a charging order.
On getting the CCJ i decided to research some more about HFO/ Turnbull Rutherford solictors and there is a whole consumer site dedicated to these people.

Apparently, HFO buy these debts from Citicard etc. and Turnbull Rutherball increase all the interest charges when the majority of the time when most of the debts are unenforceable. I have since discovered with this particular debt of mine,at the date of assignment that TR gave me, the claimant did not even have a Consumer Credit Licence with the office of trading at the time they allegedly signed the debt. HFO's status at the moment is in the initial stages of having their licence revoked and the prime member of TR solictors, Alasdair Turnbull is also under investigation by the OFT.
This is where I am at the moment, with a CCJ and charging order on a debt which was unenforceable.
I am not saying that I don't owe the money but the interest charges they have added has gone from a £5000 debt to a £9000 debt which is ridiculous and will never get paid! I know we should have asked for CCA's or copy of assignment initially but we followed the CCCS's advice and this is currently the situation I am in.
I do not know what to do next, do you think I should get a solicitor for the final hearing? Solicitors are expensive so i was thinking about fighting it myself. I really need some advice on what I should do next, can anybody help?
