  • creditcard debts and intrest

    please cans someone help, i have 5 creditcards adding up to a debt of £11,500.
    around £2000 is interest alone.
    i have card protection at around £60 a month, collective for a year of which i have been unemployed signed off by my doctor for depression,
    i cannot claim on the protection because i didnt have a contract with my employer but am still paying for the protection, i dont know how to stop it.
    i have asked the companies for help with my situation and that i would start payments when i could, any possibility of reducing payments or stopping interest and have been told its not possible.
    i am with NBMA, CAPITAL 1, EGG, BARCLAYCARD and NatWest
    A debt management programme can help, charging £3000 over 10 years but not helping reduce any of the capital owed.

    im 22 and unemployed, i can make payments of £120 a month, but dont know where to start

    Lovely to have you here :hugsss:


    First thing is get in touch with CCCS - they will help you set up a DMP and 100#% of the payment you make them will come off your debt. They can also negotiate with creditors to freeze interest. They have more weight than you as an individual and will manage payments for you so you pay them once a month and every penny goes towards your debts.

    Call them and they will call you back a couple days later and will go through EVERYTHING money wise with you and will help advise you the best course of action. Come back here and tell us what they say.

    Took a massive weight off my shoulders - although it was bloody hard actually sitting down and seeing on paper what I actually owed. You can try and do it yourself and there are a number of useful letters in the library to help...I used CCCS cause really my head isnt in order enough to cope with lots of different letters and I'd have messed something up. lol. Its what suits you...even if you talk to cccs then decide to do it yourself. They send through any paperwork to you so you dont have to make on the spot decisions. And they dont judge you.


    The Card Protection I'm not very knowledgeable on but theres a lot of peeps who are. Seems you may have been missold it.....so possibly can claim all your payments back but it needs looking at the contract and terms.

          I agree with Ame

          I'm with Payplan www.payplan.co.uk who are another DMP that don't charge you a fee.
          They will speak to all your creditors and agree a repayment plan based on what YOU can afford.
          They can get interest frozen in most cases, and as Payplan make their money from the Big Banks, The banks will usually agree to their terms as they can see you are making an effort.

          I have been with Payplan for 3 years now, and although their customer service is nothing to shout home about, they do stop the pressure you get from creditors.

          As for payment protection on Cards, if you wnat to stop t you just phone them and cancel. One of the first things that a DMP like Payplan will do is to tell you to cancel this, as they are managing your debt.

          If you want any further info on Payplan, feel free to ask.
          I have no Exp with CCCS so i cant comment on them, but i'm sure there is someone here with experience.

            Ahh I am with CCCS and they are brilliant......dont expect miracles but I havent had to worry about the 7 debts they are handling for me for months now....a load off my mind.

              also i have charges for non-payment and/or late payment and going over my limit. i read somewhere this means it cant be passed to debt collectors is this right?

                No that isn't true, it is only where the account is put in dispute, ie you dispute the amount of the debt.

                      Hi Hazel and welcome to Beagles, great to see you here.

                      Good to see you getting lots of help already, there's also lots of useful help in the debts forum including an income and expenditure sheet that will help you get your head around everything yourself before you ring CCCS or Payplan so you can make sure you have everything covered.

                      Although the banks, CC Companies, loan cos and DCA's manage to make us all feel really bad and sometimes even scared about debt, the people on here will tell you that once YOU take control of your own financial situation, you will feel so much better about it all, I know I certainly do.

                      As far as putting debts into dispute is concerned, you need to write to the company about some aspect of the debt you feel is incorrect, so unlawful charges or mis-selling PPI would both do this, then you can ask any DCA's to refer the matter back to the original creditor. Lots of helpful letters in the debt forum.

                      There is a lot to take in, you may want to pop into chat for a discussion about the different aspects, we'll keep an eye out for you popping in.

                      You'll certainly get lots of help on here and support by the bucketful xxx

                        Hi Hazel

                        you've come to the right place, you'll get loads of help and support on this site.

                        Like Iancognito says above, once you take control its a weight off your mind. I'm not out of the woods myself yet but getting there.

                        Once you feel a bit better about things and get organised you can start the process of claiming back charges etc, and getting back whats yours. You'll feel loads better once you actually get going and get a plan.

                          Hi P.ink, you stated in your first post, the reason you could not claim the payment protection, because you had no employment contract.
                          If you was a Temp or agency worker the law is a bit more complicated, but if you work/ed for a company, full or part time then Employment rights act 1996 states the following:
                          1.
                          Statement of initial employment particulars.
                          (1) Where an employee begins employment with an employer, the employer shall give to the employee a written statement of particulars of employment.
                          (2) The statement may (subject to section 2(4)) be given in instalments and (whether or not given in instalments) shall be given not later than two months after the beginning of the employment.

                          If your Employer failed to give you a copy of the employment contract, then they are in breach of the mentioned act.
                          If their breach has caused you financial and personal distress, then I am sure you would be able to claim against them.
                          You may wish to speak to someone like Ashley or Cetelco, on how to proceed with litigation, it also would not hurt to speak to ACAS, they may be able to help you, and if you are signed off work due to health issues, I think you would be eligable for legal aid.

                            thanks for all your help, I have spoken to 2 debt collectors, they have agreed to take payment of £5 a month, so i feel like i have a result there, I waiting to here back from the others.
                            ill keep you updated but i wouldnt have been confident enough to insist they except this with out your help
