    Hi All

    Sometimes these companies beggar belief.

    I made a complaint to Amex about the conduct of Newmans last year as they (and their predecessors AIC) were refusing to accept my DMP.

    Amex response was that they would accept my DMP payment and also have frozen interest and charges (see response letter attachment).

    Newmans are now sending me letters demanding I complete their own Income and Expenditure sheet. This form demands:

    What cars I own and their value

    Current value of our house and outstanding mortage

    Employer information (so no doubt they can then try to call me at work as they currently do not have this information as I changed employment last year)

    Proof of my income

    Pension information and value

    Surely the fact they have a letter from their 'client' accepting my DMP (they were sent a copy of the letter attached) should be enough.

    But instead they still send letters demanding I call them, are asking for more financial information than they are entitled to, despite the fact their client has instructed them to accept my payment.

    How many complaints do I have to put in about these idiots?!!

    I think my stance should be something along the lines of 'your client has instructed you to accept my payment plan so bugger off'.

    I think some more complaints in to the OFT and even the FOS are now in order.

    I would love them to take me to court now I really would!

        Personally I'd invite them round for tea and cakes, show them your filing cabinet and tell them to help themselves - much easier in the long run. Cheeky bar stewards!

          They have had 4 copies of my I/E sheet now (which is of a format provided by the CCCS so I know that its 'industry approved').

          I will send yet another one, and if they continue I will refer them back to their clients instructions.

          I would love this one to go all away as their conduct would get ripped to bits by a Judge I'm sure!

            Crisp, use the CFS (Common Financial Statement) i/e and just send them the Summary page. PM Amethyst for this if you can't track it down.

                Letter typed up and ready to go. Basically I've ignored the demands to fill in their I/E form and referred them back to their own clients instructions and that I will be paying the monthly amount agreed with their client.

                I'll keep you posted!

                I'm wondering now if they continue with this whether I would have grounds to make a claim under the Protection From Harrassment act.............

                  I had a similar thing with Lowells
                  I just sent a letter stating Barclays had accepted my DMP and I had been paying for over a year they then accepted without SOA

                    cut out the DCA middleman and pay the original creditor direct. if they accept payment then you can forget Newmans.

                      Yes this is the trouble. I did send Newmans a letter telling them AMEX had upheld my complaint and accepted my DMP. I also enclosed a copy of the letter AMEX had sent me so there could be no doubt.

                      Newmans have chosen to ignore this and are still sending me letters asking me to call them and demanding I complete their own SOA/IE form.

                      I'm not worried about this, I just find it incredulous that despite a letter from their client upholding a complaint I have made, where it clearly states their client advises them to accept the DMP, they are still acting in the way they are.

                      I am considering what grounds I have now to take them to the small claims court on harrassment.

                      Debt Star - Thanks for the suggestion. I do have a mechanism of doing this (online) but I am concerned that if I make a payment using my debit card that AMEX would then have my card details.

                      Do you know if this would be the case?

                      I have been savage in protecting my debt card and bank account details since I changed bank accounts 6 months ago to prevent my creditors from taking payments that were not authorised by me (which I have experienced before with DCA's).

                        It seems they all can do what the hell they like ( Cap 1 included) they have refused my direct payment and I too dont want to give them my card details on line so next route for me is a postal order and upto now not cashed
                        So if they wont accept your DMP or your money in any shape or form it could be a case of wait and see
                        I know you have given me loads of helpful advice in the past so I do hope you get it sorted

Whilst I appreciate that it may well be difficult for you to understand, as many words have two syllables or more, the general gist is that Amex have accepted my DMP and the payments proposed. Therefore, be advised that I will not be sending you an I/E sheet, in any way shape or form, as it is completely unnecessary. Please also be aware that should you continue to harass me by letter, I will have no alternative but to report you to (anyone you can think of) and issue a court claim under the Protection of Harrassment Act blah blah blah.

                          Please do not think that I do not feel strongly enough about this matter to take the actions above. As you will appreciate, it is quite difficult to write a very strongly worded complaint using words of one syllable only, so I do hope that this has actually had an impact with yourselves. If you still do not understand, then perhaps you would be advised to show this letter to someone who does? I generally find that District Judges understand perfectly well, maybe you would like us to sit down before one in a Court, so that a Judge can help you?

                            That was pretty much the content of my letter, though I did use words of more than one syllable! Plus I didn't call them idiots, I am sorely tempted though, but as I would be happy for this to now go to court I guess I had better take the moral high ground!

                            They are getting nothing further from me now, as far as I am concerned the matters closed as Amex have agreed to my payment plan.

                            I am also wondering if I can now apply the £35 a letter thing in responding to their toilet roll when the position is clear.

                              Assuming you know their sort code and account number then just make payments by internet banking. Or, pay a relation cash and get them to pay the creditor for you. Or, send them cheques.

                              TBH I wouldn't worry about them having your debit card details anyway because I would have thought that it is unlawful to take payments without prior authorisation that way (unlike say with direct debits).

                              Either way, find some way to pay the beggars direct and cut out those low-life DCAs. I'm doing that with Egg and on checking my credit files each month I see that they are reducing my balance so = accepted repayment arrangement as far as I'm concerned.
