  • Amex/AIC - How far will this go?

    Hi All

    As some of you may know I am currently in a self administered DMP with guidance from the CCCS who helped me put together my I/E sheet and prorata offer to my creditors.

    Almost all of them have accepted, the only real fly in the ointment being AMEX and their DCA AIC.

    I think this one may go 'all the way' as they have been completely unco-operate thoughout (not to mention several breaches of OFT guidelines)

    As I suspect this is the likely one to go to court I thought I would ask you good people for some help with correspondance to improve my chances should it get that far by making this lot look as unreasonable as possible.

    To help you this is the timeline so far:

    Sep 2009 defaulted on AMEX CC and account was passed to AIC (however they have not 'bought' the debt)

    Nov 2009 agreed a monthly figure with AIC (which was more than I could afford and consequently paying this led me further into debt)

    Paid this amount until August 2010

    July 2010 contacted CCCS and got advice that DMP was the best route for me. With help from CCCS set up my I/E and pro rata offer to creditors

    13th August - Email to AIC informing them of financial difficulty and DMP and new monthly payment proposal

    13th August - AIC refuse my DMP offer and also refuse to even pass my offer to AMEX (in breach of OFT guidelines)

    14th August - Email to AIC informing them this is the max amount I can afford and payment will be made to show my intention of paying the debt

    15th August - Email from AIC informing me that they are still refusing my offer

    21st August - Letter from AIC refusing payment

    26th August - Letter to AIC confirming set up of DMP and first payment will be made as per DMP

    1st Sep - Payment made to AIC as per DMP

    Today - See letter from AIC attached to post

    Now I'm thinking that this is a standard 'threat-o-gram' and was going to respond via post along the lines of:

    You are aware of my DMP and financial situation
    My DMP shows my serious intent of dealing with my debt
    You have refused to even pass on my reasonable offer to your client (counter to OFT guidelines)
    If you go to court I will present this information asI believe it contrary to the courts over-riding objectives

    What do you think?

    Hi Crispy

    We recently (a year ago) had dealings with this shower, regarding a debt with Lloyds, firstly it had gone to Apex then passed to AIC after many, many threats it was passed back to Lloyds whom we are at the moment trying to negotiate a settlement figure with.

    Hopefully the same will happen with yours and will get passed back.

        I have a problem sometimes ignoring these letters in the event they use the old 'we tried to contact him and he ignored us' routine if it went to court.

        Would this matter if I have informed them of my DMP and the situation hasn't changed?

          You have not only informed them, but made payment.

          Seems this has come from a different dept to the one that agreed it with you.

            I think thats the problem, in that they haven't agreed it with me.

            However, I did make a payment anyway (in line with my DMP) which they have accepted and processed (and is showing on my AMEX balance).

            I'm sure this would only make things tougher for them if it went to court.

              Similar situation mate only with RBS/AndresonFyfe, what it sounds like they are just out to get a bigger slice of the pie.

              Just keep paying them the amount you can afford.

              You have probably already done this but call National Debt line 0808 808 4000 it’s free and they are very switched on.

              I had also an AMEX CC however they accepted my offer straight away.

              Keep the faith mate (cant get blood out a stone)

                I had a bit of a bad day yesterday, a stonking headache and loads of work to do didn't help my mood either.

                This threat-o-gram and another DCA emaling me that they had 'visited' my home didn't improve my temper either!



                In a better mood today about things (headache and workload not gone away though!)

                  What are AIC up to?!

                  Hi All

                  Ok so today I receive a letter from AIC dated 7th September!!!

                  Now I'm not being cynical but how do I get a letter dated 7th September today when the letter I received on the 28th was posted over 2 weeks later?!

                  Hmmmmm I smell something stinky.

                  Anyway here is the content of the letter:

                  Dear Mr Crispybacon

                  With reference to your recent payment to AMEX, as we have now been assigned your account for collection please contact Allied International Credit (UK) Limited (AIC) immediately on the telephone number below, so that we can discuss the options on your account and agree a payment method.

                  Unfortunately the payment that you made was not sufficient, your account continues to move towards default status which would be updated with the credit reference agencies.

                  To ensure that you are making payments that will have a positive effect on your account please contact us on the number below. We will advise you the value of payment that you are required to make in order to achieve this.

                  Your sincerely

                  Mr DCA at AIC

                  So:

                  1) I have already informed them twice that I will only communicate in writing so have no intention of calling them!

                  2) Does this actually count as a notice of assignment? Are they merely collecting for AMEX still or have they now bought the debt?

                  3) My account continues to move towards default status? Are they kidding?! I was defaulted by AMEX almost a year ago!

                  4) They are going to tell me what I am required to pay?! I can only pay what I can afford, no blood left in this stone!

                  Should I file this under I?

                  Or should I just repeat the letter I sent them regards my DMP and repeat I will be paying them in line with this?

                      2) Does this actually count as a notice of assignment? Are they merely collecting for AMEX still or have they now bought the debt?
                      Sounds like they are collection on behalf of Amex but no this wouldnt hold up as a notice of assignment - it has to come from the original creditor (or in their hand anyway) I guess this might class as a hello letter but you need a goodbye letter from the OC for assignment too.

                        Why sorry? - I'm just aware there's people on here who are in more urgent need of help than me :tinysmile_grin_t:

                        This lot are the major thorn in my side at the moment, every other creditor (with exception of Payday UK but I will post that later!) has now accepted my DMP and are being reasonable.

                        AIC haven't been at any point (except when they 'lost' some of my payments!).

                            Hi All

                            Well the answer to the question of my post is........

                            As far as AIC are concerned this is not going to get very far at all!!!

                            Today I have received a letter from Newmans DCA informing me that AMEX have instructed them to collect the whole debt and I have 7 days to contact them etc etc.

                            Now this is a little naughty of AIC as I have had no notice that the debt was being transferred to Newmans. Nor have they given me sufficient time to cancel the Standing Order I had set up with AIC a payment which has already gone out today for Monday.

                            So looks like I am going to have to start again with Newmans. Anyone know of their normal tactics? Are they going to give up as easily as AIC?

                              Fairly normal I'm afraid.

                              I would wait to see if Newmans contact you again, then fire off a Prove It.
                              Until they stick with what you are currently doing.
