      Hi all
      Think now after all my posts regarding Assignments Laws and statutory Interest Laws that you all have given me more than enough information to challenge what this DCA Is trying to do to me and my family which is basically TRYING TO TAKE ME TO THE CLEANERS!

      The only dilemma is I have read so many posts recently where basically the Judge has either ignored what the defendant has had to say, even when the law states otherwise, not give you the opportunity to fully state your case, or just wants to get it over and done with asap with 99% of the time the Claimant coming out on top when it seems unjustified using let’s just say (TACTICS) and from the experience I have had so far I get that gut feeling as well.


      My predicament being this I have gone it alone so far but I have just found out from a local Solicitors whom deal with people in debt that I can get Legal Aid and if I lose I won’t need to pay any costs but if I win I will have to pay a fee to the solicitors and they will discuss this with me when I go in to see them.

      So is it better to have a solicitor at your side based on the current climate or do I go it alone based on the information you brilliant people have provided to me, after all the law is the law but maybe a solicitor can present it better or hold a bit more clout in the Court room.

      What do you think.

            Hiya, You seem to have been abandoned sorry. I'd say thats probably a good indication that no one knows and a specialist solicitors would be a good plan. If you are facing a 5 hours hearing with a substantial costs risk on complex LoP issues as well as the interest issue - you probably want to have a word with PT see if he has any thoughts on the worthiness of pursing this case, considering the current outcome seems to be £5 a month for the foreseeable and a CO on your house. You would probably be able to look at a settlement figure with them. Excellent that their variation order application was turned down.

            I think without all the assignment stuff an argument to stop the interest on the debt on its own might have been more successful/constructive etc.

            The contract (as far as we could see) has nothing allowing for post judgment interest.

            Not sure if my post #3 still stands ?
