    Not much to this one really, but thought it would do for amusement, OH had a Natwest credit card, defaulted for about 100 quid a couple of years ago. Was paying 10 quid a month and to be honest I reallt thought it was paid off. Anyway,a couple of months ago RMA pop up and demand 73.13 or else. Sent them the prove it letter and that was the end of them. Next thing I know Regal Credit Services stick their head above the parapet. So I send them the prove it letter. Whih crosses in the post with their next very scary (not) threatogram. Then today we get a letter back from them stating that they have recieved our lettr in which I asked for a copy of my signed CCA (I didn't), and that I must send £1 to blah blah lah to get one. And apparently I also asked for copy statements to prove how the balance had accrued (I didn't) and to get these I need to send £10 to Natwest blah blah blah. Just exactly how stupid are these muppets???

    So anyway, here's my reply

    I write in reply to your letter of 12th August. I am somewhat surprised at your contention that I requested a signed copy of CCA in my letter of 10th August, asI most certainly did not. Nor did I ask for copy statements to show how the debt had been accrued. What I actually asked for was a breakdown of the debt. For ease of reference, I have attached a copy of my letter of 10th August; perhaps you would like to read it again as you obviously did not read and digest it correctly the first time.

    May I respectfully remind you that as the purchasers of the aforementioned debt, it is your responsibility to provide details of the debt, therefore it is quite inappropriate for you to state that in order to get a breakdown of the debt I must write to Natwest for copy statements with a payment of £10. Even if RCM are not the owners of the debt, as the company demanding payment then surely you must already hold proof that this debt does actually exist? If this is the case, then please forward a copy to me. If it is not the case, and you atually have no breakdown of the alleged debt, then may I ask why you are demanding payment be made to yourselves? Or is it your normal practice to send threatening letters without any facts to substantiate your claims?

    According to yourselves , the amount outstanding on the account is £xxx, which will remain in dispute until a breakdown of charges has been received from yourselves. If you are unwilling or unable to do this, then I suggest that the case is passed back to its originator.

    If full details are not received within 14 days from the date of this letter I will consider that there is no proof that the debt exists and will enter into no further correspondence.

    I therefore hope to receive your full co-operation in this matter and would like to request a written response to that effect.





    To be honest, if they come up with proof then I'll pay them, not too much to ask that they ask nicely though is it??:beagle:

    I did similar things with the muppets at CapQuest when tey demanded a payment for an Egg loan, when the debt had already beem set aside by the county court!

    I took about a year before I told them that there was a prior dispute with the OC. capQuest, who had stupidly purchased the debt from Eggclosed the account.

    It was a great year leading CapQuest up the garden path. I sent email after email and letter after letter asking stupid questions to eentertain myself.

    Example: Anne MccShane from Capquest emailed several times in a frenzy one morning emanding paymwnts, saying it was my responsibility to pay.

    I asked her, "what debt are you referring to?"

    I rounded off the year by reporting them to the FOS, TS, local MP, BOS and several other organisations.

    For some reason, Anne McShanes direct dial number was disconnected.

    Not sure if she survived the year or not.

    In conclusion a thoroughly enjoyable exchange with CapQuest.

        I do so like popcorn- send me some over? Forgot to mention that RMA also got their inhouse pet solicitors,Westcott or somebody? on the case but one letter back to them and they disappeared into the distance.

          Leatham Lock would be the people

          RMA and their parent NCO can be a right PITA.
          I had to change my phone number because of them.
          They have ZERO grasp of CCA or even a debtors consumer rights.

          As ever don't bother talking to them on the phone as you might as well be eating ice cream in Death Valley, for all the good it would do.

            Just checked and it was Westminster Solicitors for RMA. They are no longer in the picture as RMA now seem to have been replaced by Regal Credit Services who will be receiving my above letter on Tuesday morning. I never talk to anyone on the phone and OH is expressly forbidden to do so either lol. Anyway none if them can phone us as we've just changed provider and had to change our number due to Sky cutting it off and not giving it back to BT...

              Dunno if it helps Wends but I've done searches on both Companies House and Creditsafe and Regal Credit Services doesn't seem to exist either Ltd or Sole Trader.
              Might help you have even more fun hun lol.

                    That's my letter typed up and in an envelope, they should get it tomorrow. And how lovely of them to provide a pre-paid 1st class envelope for my reply..:tinysmile_grin_t:

                      I would sent a duplicate one in an unstamped envelope. I once sent over 80 as they always claimed that they never received them.

                      That shut them up!

                          Have had a letter from Regal today. They seem to have completely ignored my previous letter and have sent a threatogram saying as I've ignored them they'll have to take further action blah blah blah, ring immediately, pay by card or cheque......

                          so I suppose I'll have to send them another letter with a copy of my last letter which had a copy of the letter before that and so on and so forth.......

                          well it's keeping me amused...only thing is OH thinks he ought to pay them.....but I've soon persuaded him that that just won't do lol. As soon as they ask nicely I'll let him cough up.

                            well, Regal crawled back under their stone.....to be replaced by Scotcall. Letter received today saying that if we don't pay up they will arrange for a doorstep collector to call. Well you'd have though they'd have made a preliminary overture, but no, they are going straight for the jugular lolololol. Oh well, looks like I'd best get typing on Monday, I think something along the lines of

                              Regal phoned me two days ago - I'd forgotten the name till you posted this! Demanded my details, name address etc.... I asked the man for his name, address etc.... He wouldn't give me his so I pointed out it was somewhat unfair to ask for mine.

                              Five mins later same man phoned my mobile, same routine....... Eventually he said didn't I just talk to you Mr XXXX, I said I never said I was Mr XXXX but I believe you did talk to me.

                              Glad you posted that letter, they reckon they're going to write and I suspect I'll need to send something similar after a basic prove it letter. If you don't mind I'll pinch it pretty much word for word.
