    Hey all

    Today I recieved a letter from Rockwell, saying 'In complaince with s77 cca' your debt is 6k and youve paid nothing (thats the abbrv version).

    This debt is a HSBC loan/bank account thats been in dispute for over 2 years due to charges. It does have a compliant CCA with debt.

    What i want to know is when Rockwell referred it back to HSBC because it was in dispute, I thought that Rockwell had 'given' it back? and that HSBC would then deal with the debt?

    Anyone have any ideas?

    I think once HSBC has sorted out the dispute which caused rockwell to return it to them (the CCA I presume) then HSBC are quite free to pass back to Rockwell.

    If the accounts still in dispute due to charges then you need to write back and tell Rockwell again that its in dispute.

    Have you paid nothing on the debt at all ?

        Thanks Ame, Its my hubbys debt from when he lost his job, we were paying Metropolitan quite happily and then HSBC upped the game and put Rockwell onto us, who were awful, mean, threatening...about that time I found CAG and Curly (hurrah) so decided I wanted my charges back and a CCA and I was going to fight them etc

        They have supplied a fully compliant CCA and when the charges case is sorted we will have to pay this debt.

        Curly, Ive sent them your bemused letter more than once so I'll not be sending it again! plus they arent asking for money just reminding me they own the debt I presume, its the first contact from them in over a year....I'll file under ignore!!

          Well I should think that they'll start asking for money soon enough, so it might be worth thinking about how much you can realistically offer them when the time comes. As the CCA is compliant that's not a get out clause, unfortunately, so the only other thing you could do, i suppose, is wait for them to take you to court then stick in a counterclaim, always supposing that the charges issue isn't settled in the Supreme Court by then.

            I thought that until the charges are paid back, they can't do anything, as the account is in dispute, or am I wrong?

              Well, no, that's right, but as it's a DCA you never can tell what they are likely to do can you lol.

                Its true Wendy, your right, but I went to Trading Standards with them over this and they left me alone and referred it back to HSBC for them to sort out my charges, fingers crossed I'll have a tiny bit more breathing space, after that God knows, Bankruptcy!!
