  • Bit of advice please

I wonder if you can help me with a couple of things please:

Firstly, I requested my CCA from Cap 1 on 18th Sept. They wrote to me on 27th Sept advising that unless I make payment of the arrears they will probably terminate the a/c. At the weekend, I received a copy of their attempt to provide me with my CCA, which is just a sheet of terms and conditions. It is certainly not an agreement and no signature or anything. Shall I just send the account in dispute letter??

I wrote to Lloyds with all my details and offer of pro rata payment which they have not accepted and say that it will go through their normal collections channel. I have not CCAd them, but they have sent a DN dated 30/09/09 (1st class) which I received on 02/10/09, asking for the full arrears by 19th Oct. Is this the correct timescales for the DN or what?

    Thanks.

I would reply to them with a version of this letter - Legal Beagles - View Single Post - ~~~ Consumer Credit Agreements - A Guide ~~~~ inc. Letters (post #7)

Is Lloyds a loan ? When you start trying to make arrangements with creditoras they will often default you before accepting and get you off their good debt to bad debt books - then they can think about stopping interest and accepting affordable payment schemes. How many months arrears do you have ?

October will take it into the 3rd month. I have both a loan and credit card with them with high balances. I have had a few of my other offers accepted from other creditors. Thanks.

Hi, despite several letters to Cap 1 ...... AID, Formal Complaint etc and still actually making a payment every month, I have received a few letters from Debitas. Again, wrote to them advising of situation and then received a letter from Power 2 Contact about a possible doorstep visit. I wrote back to Debitas and P2C rejecting the visit but I have now had a card left from one of their callers.

I am at my wits end.

        Any advice?

Don't think Debitas have sold it to P2C or anything, they have just engaged them to put pressure on me. Both companies have ignored my letter to reject any visit so I will just have to see if he comes back today or later this week. I'm guessing he will.
