    I am also in your position, have just recieved letters back regarding CCA and and no agreements.

    How have you got on with the second Letter? I am just about to post mine to DCA's

      I doubt I have any charges on my bank as no overdraft etc so that has been good.
      Perhaps I should SAR b'card. I got no where with my CCA to them so can only imagine it'd be like getting blood out of a stone to get any charges refunded!

      I really should've made a bigger effort to get them sorted before now. But if I didnt think about them they werent there!! It will 'dawn' on your son eventually. What made me realise was how things 'fall' off your credit report after 6 years, i've only about 2 to go before my defaults fall off but I want them clear so they can never rear their heads again!

      Moorcroft who act for Cahoot have said they have requested it from their client and wont chase me until they supply a copy, I stopped my direct debit to them.
      I have SAR'ed Cahoot, but they just replied with what looks like a Statement of Account, I sent them another letter to say they havent complied and some documents/info are missing blah blah......... still no reply & I imagine they are out of time now. I sent them the first request on 5 June 09, they sent a reply on 8 July 2009 stating in their letter that they are waiting on the test case and any complaints about charges etc will be stored and dealt with in time and they enclosed a statement of account. PPI charges of £1,017.89 until I cancelled it.To be honest I'm not sure if it was mis-sold, it was years ago. I just applied online I think.

      Hi Tony

      B-card came back with blank T&C from the year I took the c-card out and when I replied saying that isnt what I asked for I got numerous lettesr from them stating thats all they are legally required to send me etc I doubt very much I'll get a CCA from them, the time is well up. I had sent them a low F&F. I'm in no doubt they'll come back saying no. I think i'll SAR them now and see what charges they put on the account. I'll be happy if they accept the f&f so I can move on to the next debt and get that closed.

      My cahoot loan is with moorcroft DCA now and they came back saying no CCA at present and they'll not chase my debt. I just replied saying I acknowledge their letter and have cancelled my direct debit. I have done nothing with this one since as I want to clear the others that arent going quiet easily.

      1st credit DCA only stated in their last letter that there was no credit agreement! So I sent them the letter that Curlyben kindly supplied me and only just sent it so no reply yet.

      Goodluck with yours, as you can see the ladies & gents on here are smashing help so if you start your own thread i'm sure you'll get loads of help!!!

        or maybe not Tools v Barclaycard ( Overlimit / Late Payment Charges ) **Refunded In 9 Days**

        Go on give it a go, for the price of a stamp.

            Hi everyone,

            Got a reply from 1st credit about the no CCA available (see attached).

            Anyone point me in the direction of a letter format that I can now send to say I'll settle with X amount, a low offer considering they havent got a credit agreement etc.

              nice letter

              I'd stick with your orginal plan offer them £200 to close the account completely and confirm that the debt is completely settled. Then its not hanging over you however lightly.

                His theory is that if no agreement exists then they have no right to enter markers onto your credit file, this may be an avenue you could explore.

                As Ame has said, if you are happy to repay a reduced amount then you may be able to negotiate the removal of any derogatory information entered on your file in return for you making a payment to an account that they have no hope of recovering monies from.

                Also as mentioned, make sure they accept your reduced offer as F&F settlement.

                  In the last letter I received from 1st Credit they said they would send a copy of their complaint procedure under a seperate letter.........

                  just got a delivery from Royal Mail..... they must be desperate for me to make a complaint as they have sent me :eek2: 65 seperate copies of it!! :lol: I'm sure the post man was like 'what the hell'!! I'm tempted to send them all back in the prepaid envelopes they have sent also stating I only asked for one copy!!! :heh:

                    Well I offered them £200 & they accepted (see attached letter). Could someone have a quick look just to check I'm covered in the future should someone come looking me again!

                    My question is, since the default lodged by JD Williams will fall off in 2 years, will the account still stay on my credit file becuase it is only being marked as settled now? Have I to wait another 6 years for that to fall off??

                      Faberoonie Well done.

                      I can't see any further come back coming off of this. The debt should still fall off within the original six years. If you check your credit file next month (if its like mine) it should show the drop off date ?

                        Feels great to have (nearly) got one debt out of the way!! Just gotta get payment to them! Cheque would be best, must get someone to give me a cheque and it get sent off tomorrow or friday!! Very happy.

                            you could get a bankers draft ? or ask them for account details and do a bill payment ?
