      Hi Curlyben,
      Today I received a letter from BLS Collections asking for the entire sum that I owe on
      the OD(the one I'm going to send the SAR about). They seem to want the money asap.
      Also this has been passed to them from the solicitors Sechiari Clark etc.
      1) Will they move to take me to court asap if I do not reply to them?
      2) Do I need to move this matter to another thread/section?
      3) It will take me a week to or so to get the SAR sorted out(Finances are VERY difficult).
      4).What is the significance , if any, of the handing over of this matter to BLS Collections?
      5). I've viewed the stuff on SARs and also the hassles other people are having with
      reclaiming Bank Charges and I will keep studying these for more pointers.

      Yet again any pointers would be helpful.

      Sorry to post again, I've just viewed the post on CCA requests and I notice there is a letter
      which is a "Dispute Notice" which is sent to dispute any charges on the account.
      Can I send this as well as the SAR?

        Send BLS & SCaM the charges dispute letter and this should shut them up..

          Thanks Curlyben for that.
          Update on CCA requests, the 3rd one has been delivered so I'm now going to sit and wait. Couple of questions re SAR:-
          1). Do I make the £10 Postal Order out to Lloyds Bank?
          2). I saw a thread on Consumer Action Group which seems to imply that I can go back to
          2001 re the SAR and reclaiming charges, can I do this successfully?
          Can you help with this?

            1) yes
            2) sod that request EVERYTHING they have on you NOT just the statements.

            I ended up getting information all the way back to when I opened my account in 1992.

                Hi Curlyben,
                Update on everything.
                1). I've sent the dispute notice to Lloyds Debt Recovery.
                2)Am in the process of sending SAR.
                3). Loyds have closed the account I'm going to send the SAR about.
                4) Only discovered this when the Standing Order I set up failed to go through.
                5). Enquiries to the account holding branch don't state when the account was closed
                although one date given (on the screen) was 1983!! Confusing.

                What I'd like to know is:-
                1). What possibly are Lloyds likely to do next?

                I am going to send the SAR anyway because I suspect they are still going to continue
                to hassle me. I HAVE demonstrated a willingness to pay something while I get sorted out
                financially but Lloyds have continually rejected my proposals(ALL in writing BTW).
                I'm wondering just what else they've got to throw at me. Any ideas?

                  Hi,
                  Well, on the 6th July I "shouted" for help and did not get a reply. Fortunately the situation
                  did get clarified, however I am concerned about the non reply. As it stands I am now in a
                  situation where I will need help to sort things out.
                  I have received a reply from 1 account to my request for the CCA however this arrived
                  AFTER the 12+30 time frame. It was sent on the 14th August and I sent my request on
                  the 18th June 2009. The request arrived on the 22nd June so I think they just made it-
                  not sure. However the basis of their reply was to say that the enclosed UNSIGNED copy
                  of the LATEST CCA constituted a valid agreement and they quoted from various parts of
                  the Cnsumer Credit Act to back up their argument. I have scanned all the documents
                  as Word Documents and would like to be advised as to the best way to upload these Docs so you could possibly scrutinise them to let me know whether what they contend
                  constitutes a valid argument.
                  2 other accounts have not responded to my requests for CCAs and I put these other 2
                  in on the 11th June both received on the 12th june. I suspect that the other 2 may well
                  have sent documents so I'm waiting to receive these this week, however I feel that they
                  have exceeded the 12+30 day time frame and I will proceed to the next step. I would
                  really appreciate a response to this post because everything appears to be entering a very critical phase.

                      with regards to the time limit of 12 days for lloyds to respond to your cca request, it simply makes them in default until they produce the agreement, which they have now done. So you can forget about the dates in that respect.

                      If you can depersonalise your documents (remove your name/address/account number etc) then you can post them direct on here by clicking post reply and then the manage attachments button to upload them (the site won't accept .docx only .doc so save in 2003-2007 word format) otherwise, if you have any problems, you can email them to amethyst@legalbeagles.info and i'll upload them for you.

                      thats really next thing needs doing is to see what they have sent, sounds like they have sent a generic agreement which doesn't comply properly at the moment, but wait till someones had a look for you.

                      the 2 who havent complied, you can chase them and continue paying for the moment, or you could (depending if you fancy fighting your credit file later) stop paying until they comply.

                      the time scales are actually now 12 working days. The 30 days is obsolete since they removed the criminal offence, and after 12 working days the creditor is simply in default of the cca and can't enforce the debt without the permission of the court. however it can become enforceable if they should come to supply it at a later date (unless you get a declaration otherwise or the creditor to agree the debt doesnt exist and write it off).

                      Hope that helps a bit for the moment.

                        Thanks for the prompt reply. What you've told me clarifies things tremendously.
                        1). I've stopped paying all three accounts + the current account I hold with Lloyds( I've sent an SAR to them).
                        2). I take it that I'll have to keep waiting and waiting for the other 2 accounts to
                        produce a CCA before I do anything else.
                        3). I also realised after some thought that if what was stated in the documents you
                        will see, was correct why did Lloyds take so long to come out with this argument and
                        why haven't the other 2 OCs
