    I recently posted about Cabot stating they will send an Orbit Agent to my house. I was given advice to send a statue bared letter. I thought I had not had contact in 6 years but found an email I had sent them in 2021 which only makes it 5 years since contact. The debit is a Northern Rock loan from 2004. I owe £10400. I was previously in a debt management plan but paid all but the northern rock loan off when made redundant in lockdown. They ring and email me almost every day. I’ve moved house and now get letters sent here too. They say an orbit agent will visit unless I called them by last Wednesday. Can anyone offer any advice on how what to do? I don’t think it’s possible to ignore them for another year! Thanks in advance

    The best thing to do is stick to one thread.

    You could send them a CCA request, they have to provide a copy of the original agreement.
    If they can't provide a copy, then the account is 'unefoceable'. They have to tell you that the
    account is 'unenforceable'. They can't mislead you into believing the account is 'enforceable'.
    Because the account was taken out in 2004, it may prove very difficult for them to get hold of
    a 'True' copy. Make sure you get Proof of Postage.

        Making contact with them in 2021 doesn't necessarily mean the debt isn't statute barred. It depends what you said to them in 2021. It only restarts the 6-year statute barred clock if you "acknowledged" the debt, for example by agreeing that you owed the money. What did your 2021 email say?

          I did acknowledge the debt. I asked for a settlement figure as my husband had been made redundant so was going to clear it. An orbit agent visited my house today. I didn’t answer and he pushed a card through the door to persuade me to contact them. Do you think I should send an email asking for an original copy of the agreement or will it have to be a letter? Thanks

            A letter is best. Make sure you get Proof of Postage.
            Orbit has no 'powers' at all, so don't worry about them.
