  • Lowell/overdales and mental health

    Hi all

    I am currently organising debts belonging to my partner due to his poor mental health. He has anxiety and depression (medicated) and has made some what of a mess of his finances over the years!

    For a while now he’s been contacted over email by Lowell’s regarding a debt owed to Novuna- this was a personal loan he had around 3/4 years ago and stopped making repayments. He’s never contacted or paid Lowell’s for this. This has recently been passed to overdales who have contacted warning him of a CCJ.

    In the last 6 months he’s been contacted over email again by Lowell’s regarding a loan originally with Halifax that he has defaulted on. I queried the amount owing on his behalf as it was listed as Lloyds- of which he’s never had accounts with (turns out Halifax are part of Lloyds group). No payments have been made.

    I wrote to both overdales and Lowell’s on behalf of my partner and stated that he has poor mental health and I am acting his behalf. They responded asking for his authorisation etc. Since my email, he has been contacted via email alerting him that his account is on hold for 30 days due to circumstances.

    My question is, what do I do next? With me on maternity, him recently liquidating his company, we don’t have much money left after our bills right now.

    First try to stay calm, when you think about it, distract yourself.

    Are these personal loans / accounts? Are they covered by the CCA 1974?

    If so, send the following:

    a) Send Lowell's two CCA requests one for the Novuna Loan and one for the Halifax loans.

    b) Send Lowell's a Subject Access Request for each account, they have 30 days to provide all the data on the account. Make sure you get Proof of Postage.

    The thing to remember is that you have options.

    Update the thread when you start getting the requested information.
