  • Help needed Lowell/Overdales - Letter of claim

    This relates to 2 accounts, one a Capitol one card and another a new day card.

    they have included some information and a reply form.

    Here is a copy of the letter.

    I am stressed out about this as my wife has just had a c section and has an infection. Can supply any other information if needed

        I lost my mum and dad and got myself in to a mess financially, I suffered with depression and anxiety and got myself in a lot of debt.




        I don’t remember which debts are which and the whole thing is a bit of a mess. I had a debt management plan with StepChange the last payment would have been around November 2020.




        Since then no payments made on any debts and at the moment me and my wife have 4 young children and are struggling financially.

          Do stay calm, you just need control over this, do things that calm you down -

          a) Send Overdales a CCA request for each of the accounts (so 2 requests), make sure you get Proof of Postage.

          They have 12 days to provide a copy of the CCA Agreement with Terms and Conditions.

          b) Fill in a Income and Expenditure form (take into account the cost of living, i.e. food, energy etc, remember things could go up more) remember a Court will only ever ask you to pay what you can afford, these debts are non - priority debts.
