  • Best way to pay

    Hello, I am in need a bit of advice, A debt collection agency bought the debt from my credit card back in November and has been sending me begging letters ever since and I’ve not responded .
    This was a delaying tactic by me until I had gathered the money to pay it off and I now have enough.
    I don’t trust these parasites so I’m asking the best way to make sure that that they do what they should do and record the debt as settled on my credit file.

    Sending letter stating :-
    :- reference alledged £xxxxx owed:- please confirm in writing that " FULL & FINAL SETTLEMENT" would be entered on CRA files..

    before rushing into this what was the alledged debt and to whom??? etc last payment, ?? some will accept or state later in letter we offer 30% discount etc you know purchasers pay pence per pound for debt? file then state partially settlement, that also when if you paid partial use the Final settlement.

      How old is the account? If it is 'unenforceable' then you can make a lower payment on your terms, if you choose to 'settle'.

        Hi again thanks for the reply’s.
        It is a capital one credit card dating back several years well over 6 years
        When I got into difficulties we agreed on me paying back £50 a month.
        The last payment was in November .
        If I ask or they offer a discount, will that damage my credit score ?
        the credit the card is not shown on the credit score site and my credit score is very good so should be able to take a hit, but is it worth it? Thanks for looking Andy

          If you've been paying £50 a month for a number of years, then why are they still seeking £4,000?

          If it's dropped of your Credit File, they can't put it back on there.

          Send them a CCA request, see if it's 'enforceable', see what documents they send you, then reassess how to deal with the debt.

            Sorry I didn’t explain myself properly, the credit card debt was originally £8000,I have paid off £4000 at £50 a month, then they sold the debt to a DCA and I need to pay the £4000 remainder. thanks for your time Andy

              DCA are only agents asked to collect on their behalf of owners (they get good commission for running account)

              send the CCA1974 request with a £1.00 postal order get proof posting and keep copies of all on file. as was suggested above. paying £50 per month maybe cash cowing you. no CCA no pay or if you want can ask for a very low settlement figure as they can not get a CCJ with no CCA., but we do not know unless you make the request.?

                Agree, dictate the settlement on your terms, no CCA start with a low ball park figure e.g. £400, they should consider themselves lucky getting that offer from you. In the alternative 'no' payment.
