  • Default Sums claimed by DCA for Issue Costs/Fees for CC Claim which was stayed.

    Hi there
In 2019 a DCA took me to Northampton CC for a Credit Card sum.
I defended and they failed to provide CPR 31.14 etc and the action was stayed.
They have now sent me a letter saying that "The following costs have now become payable under the Agreement"
Issue Costs £80and Issue Fees £185. These being the fees to enter a claim with Northampton.
"This notice is about default sums and is given by us the Consumer Credit Act 1974"
    How should I respond, please.

The DCA took over the debt from Barclaycard. I am not aware of any agreement. Certainly the DCA could not provide any details when requested to support their Court action.

You need to ask what agreement they are refering to and request a copy.
