    If there was a debt or balance they would not close the account without both signatures, however they should have froze the account when you informed you were having difficulties.
    I would add up the charges and if it comes to over the current balance then put it in your name, use the refund to clear the balance and close the account.

    Regards the NR shortfall, I wouldn't bother ringing them but send off a SAR and see exactly how the £29k was paid off, if it was covered by a MIG then there is still the possibility that the insurance company will come after you.
    CRA's are good for a snapshot of your finances but dont always show the full picture and any underlying issues.

    It may be an idea to try and get the CCJ set aside and in the meantime save up the money to pay it off before they get a chance to re register one.

    Have you spoke to a divorce solicitor about your finances through the split? Has this been to court?

      i have spoken to the solicitor and to be honest the only thing they seem interested in is getting alist of my incomings and outgoings for the exs solicitor to see if their is a financial claim from the marriage. i hav told them re debts and they said just give a list and they will give it to his solicitor to ask for him to make a contribution if he can. he cannot be forced but can offer. the bloke isnt paying maintenance so he isnt going to pay for any of this

        MIG = Mortgage Indemnity Guarantee (I think).


        Have just read your thread, my advice is don't have a loan. In your current situation you would probably only get one at ammgea-high interest rate which would in turn end up making you worse off than you are now and lead to more financial mess and worry. I know it seems more pressing as its a member of your family you owe the money to, but maybe when you've got the Income and Expenditure form sorted out, and restructured the debts and payments etc, you may be able to pay him a bit more each month.

        There will be a light at the end of the tunnel, and there will always be people around on here who will help.

          if i had the time then it would nt be so bad, but my dad needs his card paying off due to illness and therefore may need that as back up so to speak and with his credit card company now chaning company is also concerned they may want to ask for full payment or additional payments.

            Has he got Payment Protection on his card? If so, that may cover him for payments if he is ill. And if he's ill and got no money coming in, it might not be wise of him to use it as back up, in case he gets in a mess and can't afford to pay it himself. Sorry don't mean to offend here. So you could say you are doing him a favour by not letting him use his credit card to run up debts for himself lol.

              he had cleard his card already after becoming ill but then let me use it as a stop gap and obviously was meant to have 2 people paying it off so it would be alot quicker. so it is taking alot longer and as it appears to have a high apr on it the amonut isnt really budging down alot at all. and at this rate every 200 i pay only about 10 comes off of my bill as the rest is interest.

                Just been reading through your thread and sorry to hear about all your problems but there are loads of people on here with lots of knowledge and experience that you will be able to lean on.

                Just a thought about your dad's CC ... is there any way he can apply for a 0% card (I think Virgin have one that runs for about 15 months but you'd need to check them out)? I know you'd have to pay around a 3% transfer fee but that would be a one-off payment and the rest would be interest free PROVIDED you make the payments ON OR BEFORE DUE DATE (best to do it before else you lose the 0% and go onto a higher rate - I know ... I've done it!).

                Also if you carry on making the same payments (£200 I think you said) then you would pay it off much quicker.

                Just a thought.

                  thanks - i think he is looking to see if that is possible. although think tat may be difficult given the fact he doesnt work now - but hopefully it will be possible and some help.

                    ok i have sent the letter to howard cohen to request the proof of me owing the information on this ccj, however it has been a month and a half now and i have had no response. so what do i need to do now write to the court to advise them??

                      This is precisely what happened to my brother when he and his girlfriend split up. She went and closed their joint account on her own without his knowledge let alone his signature.
