    Hi all

    just a legal question i dont know if anyone can help?
    Is there a legal requirement for a default notice?

    I am in the process of disputing a debt with Howard Cohen Solicitors.
    They have issued a claim which i have defended. I sent the letters recommended on this forum and followed the advised process.

    Howard Cohen have written back exactly 28 days after my defence.
    They inform me i have a debt for an Egg card which was sold to Barclaycard. They give the dates for the last payment and date of the opening of the account in their letter.
    They have attached an assignment notice and nothing else.

    Now this is absolutely NOT the case. I had a dispute with Barclaycard but this was not an account which was opened when they say it was, it was NEVER an EGG account and the last payment date is way out - it is like they have confused me with someone else.

    Their letter says they have notified the court they want to proceed. I want the default notice and copy of the original agreement as i reckon this will show the true position. If this relates to the claim i know of - am happy to pay it. I am not paying an Egg claim which is thousands more and definitely not mine.
    However, i am sure somewhere i have seen something that says there is legal requirement for default notice and if they dont have it - court wont enforce it? Am i talking nonsense here xx

    letters you sent CCA request with £1.00 ? & CPR31.14 requesting copy all documents listed in the court claim??
