    hi

    due to moving home sept 2005 ,relationship break up 2mths later , getting £10.000 loan to pay off partner and being left with £4000 kitchen to pay for as well + items ld paid for towards the home on my c/c, 2 family deaths in 3mths [ 1 was ex hubby+ still friendly with] 2 major ops + ppi refused to pay out after id kept up full repayments for the 4mths l was off , loads of harrassment from halifax by phone even though paying thro CCCS DMP [ 8 calls in 1 day not bad eh??]
    l work for a national health adv line , VERY stressful speaking to all sorts from people having heart attacks /suicidal /self harmers /rape victims and general medical probs needing emergency attention a combination of all of this has resulted in me having 3 periods off sick due to stress+depression lm on b/pressure tabs and antidepressants l have had my home up for sale for 18mths to get straight +been let down 3 times ,tried to go back to work 8 wks ago after 4 mths off and cannot cope ,started panic attacks and crying
    again so been signed off for 1 mth by gp

    in that time lve still managed to get £3,425 deducted from my p/loan due to missold ppi [been agreed aug08 +still waiting for halifax to take it off] and approx £2,500 in bank charges /interest on my other debts ALL with help from the FOS who ruled in my favour on all 4 complaints after the halifax basically told me to go scratch !!!

    lve been on reduced pay during my sickness and now just on ssp l know l cannot cope with my job any more l have enough problems of my own eating away at me
    latest thing to worry about is that whilst lm still waiting for the halifax to take the ppi refund off they,ve had the cheek to pass the debt from blair oliver scott their in house coll dept and pass it to CABOT who had no idea that the ppi should have been taken off lve sent them a copy if the letter from halifax agreeing the refund and their looking into it after reading a blog on cabot which l found on a like on a post on another forum they don,t sound very nice
    and l know this is totally irrational but they are only 5 miles away + lm worried l might get as visit EEEK!!

    So in a nutshell.
    Halifax loan with PPI.
    PPI cancelled and refunded.
    Debt sold to BOS and then Cabot.

    Ok so far ??

    So what are our "friends" Cabot threatening on this one ??

        Hello Carrie,

        Your debt with Halifax is clearly in dispute and as such Halifax should not have sold it or assigned it to Cabot. It is against the OFT guidelines on debt collection.

        Write to Halifax at once and instruct them to recall the debt from Cabot and apply the PPI refund or you will report them for their conduct.

        I would also send them this letter:-

        Dear Sirs,

        Account Number:

        Please take this letter as confirmation that I will no longer be discussing my financial business with you over the telephone. I now require all contact to be made in writing only.

        As I am sure you are aware Harassment of Debtors is a criminal offence in England and Wales under Section 40 of the Administration of Justice Act 1970.

        Furthermore, continued telephone calls after the receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.

        In addition every individual has a right to be free from harassment under the Protection from Harassment Act 1997. The offence of causing harassment is arrestable under the provisions of Section 24(2) of the Police and Criminal Evidence Act 1984 and attracts the powers associated with such offences. Additionally Section 3 enables a person who is, or may become, the victim of behaviour prohibited by Section 1 to take civil proceedings against the perpetrator.

        Further it is my contention that your company is in breach of the Office of Fair Trading guidelines on harassment.

        If I should receive another telephone call from any person from your company at any point then I will be contacting the police to report the criminal offence of harassment and will be naming you in my statement to the police.

        I trust that I have made myself clear and that all future correspondence with your company will be in writing, therefore kindly remove my home telephone and work telephone numbers from your system at once.

          sorry just realised l need to give info on debts :bolt:

          halifax loan was £12,000 now £9,425
          halifax c/card was £7,000 now £6,335
          halifax o/d was £517 now £211
          halifax o/d was £909 now £865
          rbs c/c was £800 now £701
          mint c/c was £1,930 now £1,775
          egg c/c was £2,598 now £2,376
          kays catalogue was £222 now £191
          lloyds loan [ v old] was £4000 now £2,500

          as you can see l kept all my banking with the halifax for 17yrs who were great when you were up ..but stamped on you when you were down
          also at the time my ex partner was on fantastic money " dont worry ill help you pay off things ... yeah right even ccld the insurance for our 2 dogs as he could afford vets fees ...... guess whos paying then now....:rockon:
          but hey lm alive and breathing and got a wicked sense of humour.. it could be worse ..

            It is nice to watch the numbers falling isn't it.

            I got my CCCS statement the other day. What you do need to do, and I need to do too, is check the actual balances with the creditors, the CCCS doesnt account for charges /interest etc in the debts. I'm not checking mine yet tho because its too nice to see them going down, and I don't want to rock the boat.

            I agree with what Amy's said you need to write to Cabot tell them to send the debt back and Halifax and tell them off for passing it on while its in dispute, also the harrassment letter should help matters. If you want a hand with the letters yell.

              not threatning anything so far .. nice letter introducing themselves asking me to ring did so and adv them had crap time with halifax so wont take any more but put nicer than that. told them re ppi refund so they asked if i had proof + send it on to them + inform cccs that they have taken over debt. l did as asked and they rang 1 wk later to confirm got copy of ppi refund letter from me and said they will get in touch with halifax to confirm,l told them lve been trying to do this since aug so good luck.!! they expected 3wks till they hear from halifax as apparently the details of the ppi refund may have been archived in which case it wopuld take longer .
              l just seen to get rattled easily after all the crap ive been thro

                I would advise you not to speak with Cabot on the telephone again. When things do not go their way soon, they will not be so accommodating.

                  thank you soooooo much for your advice yes its great to see the debts go down even if it only a bit

                  l think lve been luck by kicking up such a stink about the added interest payments whilst on dpm l l managed to get all of them frozen , on some forums people have tried and not been so lucky

                    Carrie, you really should read "The Rules" for dealing with DCA's

                    Consumer Credit Agreements - A Guide - Legal Beagles

                    The same applies to a certain extent to the original creditors.
                    Never give them more ammo then they already have.
                    Keep everything cordial and, most importantly, in WRITING.

                      Just wanted to say that I think you are doign brilliant and keep going. I have had depression in the past and completely understand that its really difficult sometimes to see the good, but just remember how well you are doing, you have faced your problems and are working through them. Don't feel guilty about being off sick - you need to look after yourself, so take the time you need and don't be too hard on yourself.

                      Things will get easier and you have friends and support here. Good luck for the future :grouphug:
