  • Dispute with Honda finance

    Hi Everyone,

I'm in a big disbute with Honda and Honda finance, they have written to me admitting that the change of details, all described below was there fault and that it was a 'system error on there side' yet when i've tried to claim back the money they owe me there trying to wriggle out of it, I would really appreaciate any advice and help.

In 2004 i got a car through honda on finance, the finance was taken out at the address i live at now, after having the car a while i moved out and into a flat, i informed the finance company of my temporary address so any info they could send directly to me there, while i was still at the flat, i actually paid off the finance on the car and so that account was settled.

Last year i got another car on finance, yet again through honda and honda finance, when we went through all the paper work, the right address was given, which is the address that i am at now, it also being the same address that was used when i took out the first finance.

I went back to anothe honda dealer to see if they were interested in buying my car, due to the credit crunch i though that i would try and limit my outgoings, they were very interested in my car, but due to there stock levels they were unable to take the car off of my hands, which is fair enough. whilst there they asked how much was outstanding on my finance, i told them roughly what it was. The next day my partner went in there to test drive a car, whilst there they asked told my partner what they had my address as and asked him to verfy that, it was the correct address and not thinking anything of it, my partner told them it was the correct address. A little while later they then informed my partner of my finance settlement, this then surely breaking the confidentiality terms of the data protection act?

A few weeks later i got a letter forwarded to me from the flat that i lived in when i had the previous car, i had absoluetly not idea why honda finance had started sending my letters to that address when previously they had been using my correct address. The next day i recieved a call from tesco personal finance telling informing me that the loan that i had been accepted for was now being denied due to them finding credit in my name at another address, i had absolutely no idea what they were talking about so they informed me that i had finance through honda at the flat address, and asked if i knew anything about this, i told them that yes, i did have honda finance but it was never at that address.

Due to this loan being turned down, the main reason for applying for it was to consolidate all my debt into an easier managable amount, i was left to struggle to pay my bills. with the help of my partner we wrote to honda a long letter explaining all this and asking why on earth my details had been changed.

after a wait they wrote back and admitted that it was a 'system error' on there side and that it was there fault. i find it funny how my details were changed after visiting the honda dealership. i then wrote back with all the details on how due to there 'system error' i had been unable to get the loan and therefore struggled to pay bills, and then getting lots of charges due to not being able to pay my bills. honda finance then wrote back asking for all the details of bank charges ect, so i sent them a nice fat envelope with photocopies of the charges and so on.

i have recieved a letter back from them trying to blame tesco, saying that they must have come across when i lived at the flat for a period of 4months and was known at that address, but that finance account was paid off fully and i had been back at the address that i am at now and what the finance was taken out at for over 3 years. then in the next sentence have said this.

'with this in mind i would like to draw to your attention to the application you made to us in june 2007 which lead to your current agreement with us. whilst carrying out the investigation of your complaint it was noted that this application stated that you had lived at your current address for 25 years and that you did not supply a previous address of any kind. whilst underwritting this application we located an undisclosed address of (the flat that i lived at for a short period of time) but we had no fraud concerns as you were an existing customer of ours and had used this address in the past'

sorry to have rambled on for so long but im in a right pickle and would really appreaciate any help anyone can offer. when i took the current finance out, the salesman was told that i lived at another address and that i had let honda finance know that address, the salesman asked how long i had been there i explained i was only there for 4 months 5 at the most then went back to the address that the finance was taken out at. as i was only staying at this flat as it was a boyfriends place and the previous address (my parents house) was where it was taken out the salesman informed me that it wouldnt make a difference and that the finance was still based at my parents house, so he was informed at the time of sale.

once again, sorry for rambling on!! and look forward to any help and advice you can offer.

    Re: Dispute with Honda finance

    Hi angelnatty

Just to try and break this down a little.

You had car finance with Honda at your current address, you moved out for a few months during which time the correspondance address of the finance was changed, and paid off that finance.

You then returned to your original address took out new car finance with Honda under your current address and that is still being paid off.

You applied for a loan with Tesco which was agreed in principle.

Honda messed up something on their system and started corresponding with your temporary address again.

Tescos withdrew the loan offer as they found you had finance at a different address due to Hondas incompetent altering of your address details.

The undisclosed address paragraph was in the letter from Honda (sounds like rubbish intended to make you think your case was weakend by it)

Does that sound about right (a bit more concise anyway)

            Re: Dispute with Honda finance

Angel, just write the points you want raised. Be clear and concise; give a brief history of the problems caused, what you wish them to do to remedy the situation and a time by which you expect them to do it.

If you post up a draft I'll help you fine tune it.

              Re: Dispute with Honda finance

              Hi Amy,

This is one of several letters that has gone between myself and Honda, they admitted that the problem was there fault and then asked for all the proof of how there 'system error' had effected my financial status, which I gladly sent them a very fat envelope of the proof they requested.

I can only assume that they've read the documentation that I have sent them and realised just how much they have mucked up and the amount that they would have to pay me back.

They are now trying to say that it was my fault, as they have me recorded as being at another address, yes this is true, but this was only changed for a period of 4-6 months as a correspondence address and the cars finance was still at my home address.

I will try and get a letter drafted and put it up for you asap.

Thank you so much for your offer of help.
