    On account of I cannot get hold of statements going back any longer than 6 years on this account, I have had to stick to starting claim number 2, with the statements I did have already in my possession just 98 to 99, totalling £1795 in charges. I wanted to do older than that but have had full sar file sent to me and can find no info in there relating to anything older than 6 years. I have really been bashing my head against a brick wall on this one. I know on the site over the road they have said you can get info going back to 1926 or something, but I have been told point blank iin writing I cannot get them for any longer than 6 years, end of story. So dont know quite what to do about that now.

    Anyway, decided to start number 2 with the statements I do have which I had saved in my filing cabinet in the garage (gawd knows why), so want to charge Contractual interest on this. If I can get away with it, it takes the claim up to around 6 thousand, so well worth doing, but just not sure what arguments to use in court, if it gets that far, which Im sure it will, in terms of going back older than 6 years. All of the charges are older than 6 years on this claim 2, so not quite sure where I stand in relation to legal arguments for this and using Contractual. Any help would be very much appreciated.

        Hi Fendy, I have been out of the more recent CI discussions, but there is now appearing a trend toward using Account of Profits in these claims. Basically, we use the banks' published accounts and determine what their net profit was, as a percentage of their total turnover. This percentage is then applied to our penalties, as we are disgorging them of the profit they made from these charges. This is usually a higher figure than the CI would have been, and so we offer the option of settling at the CI rate as an alternative, or a gesture of goodwill.

        Additionally, I believe that we can then use the LA s.32, as we are able to show deliberate concealment.
